Homeowner's rights to fibre?

I wanted to know what right(s) does the homeowner have with regards to the installation of the fiber optic cable installation on their property/land without his or her consent to it. So if the infrastructure was already installed on the homeowner's property, and the homeowner is part of a homeowners association but he/she had no idea that the installation was taking place.

Can anyone please advise?

The answer is your title deed and read together with your municipal bylaws\hoa rules.

Is the installation going through your property or terminating inside of it

If its through your property to supply a communications service to someone else then the ECT act covers that (think of the Telkom poles in everyones yards)

Is this part of a sectional title complex/estate?

Depends where, my place all of it is trenched, everywhere in Cape Town CBD is trenched, so is Camps Bay, most of Sea Point (where they swapped from cables on poles in the older houses in the one section, my friend now has trenched there instead, so less wires).

Trenched in my area as well.

That is unsightly!
They trenched in my area as well , was not too much of a hassle and almost a year later you would never say anything was dug up.

With regards to the OP question : your HOA should have been informed if this is an estate\complex and they would have in turn notified all members. Unless this was just a wall box installed on your boundary wall?
