Stuntwoman sues RAF, stakeholders for R40m in damages

Pretoria - A stuntwoman who suffered devastating injuries during the filming of the world-renowned science fiction action film Resident Evil: The Final Chapter, during a scene which was shot outside Pretoria, had instituted a claim for more than R40-million in damages against various stakeholders.

Olivia Jackson’s career as an actress and stuntwoman is now over, it was stated in papers before the Gauteng High Court, Pretoria.

She was known around the world as a stunt double for top actresses such as Charlize Theron.

She suffered a multitude of injuries, including head injuries, a punctured lung, facial injuries and an amputated finger when things went wrong during one of the action scenes.

The scene was shot on September 5, 2015 along the N4 extension near Pelindaba.
She was driving at high speed on a racing motorbike while being filmed by a camera fitted onto a mechanical crane. This was in turn fitted to a vehicle, which drove towards her while filming her from the front.

Jackson is, among others, suing the Road Accident Fund, as well as the camera operator, the driver of the vehicle to which the camera was attached to and the director of the film - all in their personal capacities.

I'm sure her lawyers will try anything, but I can't believe the Road Accident Fund was intended to cover movie stunts filmed on a public road.

Surely the producers and director would be most liable (and their insurers), but possibly they no longer have any presence in SA, and the company subsidiary probably folded after the film-shoot ended.

Jackson meanwhile stated she earned at least R200 000 a month as a stunt performer. She was due to relocate to the UK to do stunt work there, where her income was estimated at £20 000 a month. She was now rendered unemployable, she said.

Lawyers love to make up numbers based on optimistic projections of potential future income.

The t-virus is akin to mild cough compared to the diseases making the rounds in the city of gold miners.

Fitting that they would shoot a zombie movie in jhb cbd. You're not going to get much more authentic than that. Free explosions and gunfire included.

There are risks associated to being a stunt person. Suing the RAF is BS. I'm really sorry she lost her arm though.

Good points. There are many reasons why Hollywood actors do not perform their own stunts.

Being an actress and a stuntperson seems to invite a short career in both, and now she wants others to pay for her choices.

The makers should have massive insurance to pay compensation, and if not they should pay out of their own pockets. Particularly those at the top of the chain who are responsible for what happens on the set and stand to make a lot of money off a film. But filmmakers have a long history of cutting corners and hanging the maimed out to dry. Wouldn't be the first time a stunt person has had to sue for what they should have been offered without a fight.

Seems like safety on this set was not of much concern. But then again, the movie is shot in SA so if they try and skimp on cheap locations I suppose safety is also skimped on :eek:

There are actually a number who do perform their own stunts. Quite often due to their dedication to realism. They have the willingness to spend the time training and then take the risks performing the stunts. Not for everyone obviously, but I do appreciate those actually willing to work hard for the vast amounts they get paid.

As with many job there are risks, so appropriate cover needs to be taken.

Question is who was she covered by and did they pay.

Going after broke as ass RAF is stupid tho.

Going after the RAF is the equivalent of a drag racer who go maimed during an illegal drag race suing the RAF. The result will be the same.

Yoh... if they'd lied or misled her about he insurance they must *** en betaal.
Medical bills aside, those are life changing injuries and loss of earnings.
