Having an altercation with BUPA, a UK based medical scheme to which my mother in law has been a member since 1991.
She had a series of treatments in a Constantia hospital in 2011, the total bill came to R 252 000. Despite having had many claims paid in the past, and this claim being well below the £100 000 annual limit, BUPA have declined to pay, citing 5 different reasons why they should not over a period of 2 years. The Ombudsman for Medical Services has instructed them to pay (since they are registered in SA) but they will not. He says he does not have judicial oversight should a company decline his ruling
A court hearing was scheduled for January but when the Advocate and I got there, the matter had been taken off the rolls the previous day, on instruction from this attorney, the court clerk said. This attorney represents BUPA. It occurred again at the next hearing in April. Each time I attend court, it is another R 20 000 for the advocate. Another hearing is scheduled for 15th October and I have instructed my attorneys to ensure that the matter is not removed from the rolls and if it is, to complain to the magistrate
BUPA's attorneys take 3 months to reply to correspondence and as far as I can see, are employing delaying tactics in order to make the case go away
Speaking to the clerk of the court, only court officials are able to remove cases from the roll, but here it is being done and no-one knows why
