I suspect I bought a stolen phone, what can I do?

I bought a phone second hand off gumtree. But the IMEI on the box doesn't match that in the phone's software - I know, I'm an idiot - this is the first thing that you should check.

I confronted the seller, and he agreed to give me my money back but now he ignores my calls.
I know his name and surname, the area in which he lives (possibly his address and where he works as well, although I'm not certain), and his cell number.

Looking for suggestions here. Can I report him to the police? Do they even care? Whats the chance of getting my money back?
He could just say that he bought it second hand too and was unaware, although he told me he bought it from a vodashop, so false information at the least, but my word against his. The IMEI on the box checks out with the store.

If you met in person, it will probably be classed as a civil matter, so police will most likely send you away to the small claims court.

If the transaction was done purely through email and online interaction, then open a case of internet fraud at the police station as this is a criminal offence.
