So I went through the steps as outlined in the previous email about cancelling the 2 year contract, heard nothing, then sent another email to ask what was going on and where to deliver the modem. Got this:

RE: REQUEST TO CANCEL

was

They've not responded to a single one of my complaints with the service (or lack thereof) or the fact they changed the contract, both of which I mentioned in my original email to cancel. So professional!

What next?

You gonna have to fight. But that is a very unprofessional response to say the least. They could at least couch the initial rejection in the usual corporate nice rejection way.

I think maybe take a harder stance. For example don't use the word request, and state the reasons for your termination of the contract, or something like that.

Also remember you did sign a contract and if you can't prove their in breach of it, you will have a very hard time cancelling. I think you just need to get through to the right person at wbs and explain your situation and why iburst is no good for you any more.

Their word...not mine - I did not request, I informed ;) I only got this reply after I had emailed a second time to find out where to drop the modem. I stated all the reasons for terminating in my email, and funnily enough, not a mention of them in their reply.

Tell them you're bankrupt and don't have the financial means to honour the contract.

Very 'strong arm' tactics in that e-mail, please don't fall for it. Makes me think of Telkom and the faaker who pulled out my show boards last weekend....

If you've signed a contract you don't have a leg to stand on. You are basically at WBS's mercy.

Rule number one: No contracts!

... unless they haven't been providing the service they promised you ...

If you can prove you've had sub-standard service in any way, including issues like incorrect billing, then you make WBS aware of your dissatisfaction and demand a cancellation.

If you can't prove anything and you signed the contract, your stuffed - you just have to wait for WBS to breach their contract with you, but you'll probably find lots of small print that allow WBS to pretty much do what they want. "subject to change without notice" and all that k@k.

A whole bunch of us on this forum cancelled with Sentech last year, because it was blatantly clear that Sentech didn't have a leg to stand on as they falsely advertised the products abilities and messed up something rotten with their billing.

If you have no luck, you can always try to get someone else to take over the account.
