Internet Piracy: What happens in South Africa when you get caught?

mmm... this has been in the news quite a bit lately... time for alternatives!
 
oh.. so stealing piles of money from the taxpayer for your own fat arse is okay... but p2p isnt. lol
 
I’ll stop P2P downloading when someone actually gets convicted, which by the looks of mbb articles it may be soon
 
This is a FAIL article. Firstly you cannot just look through someones computer (with warrant) and say "Mmm, this looks like copyrighted material". What if I recored it off the TV or other broadcasts? Or if I owned it at some stage and the original got lost?
Secondly, how to you bust someone in the act of distributing copyrighted materials? You will first have to proof that what is being distributed is indeed copyrighted material and then you will need to proof it is being distributed to someone that does not hold a right to the material?

Explain to me how on earth are you going to do that taking into account cross border transfers via encrypted peer to peer connections ?
 
Yes I can see that's what the courts in SA are going to be spending their time on - P2P downloaders. Much more important than murder, rape, theft, corruption, etc, etc...

The cannot prove that you have or distribute copyrighted materials - it is impossible.

So let me get this straight..... how long do you get for robbing a gas station, and stealing R20,000

because if you download 4 Music CD's, you would get up to 12 years ?



Seriously - Pointing a Gun at someone's face and stealing R20,000 is not the same as downloading 4 CD's, which you might not have bought anyway.
On the one hand you have a persons life at stake, on the other it's a few bucks that go to a Rich Recording Artist, who drives a Ferrari Enzo.
 
This will be impossible to enforce. Our courts are already overcrowded and there are much more important crimes which will take precedence.

Yup ... like paying for it.

With the cost of our bandwidth it is almost cheaper to buy the original.
 
I think the ISP`s unhappy about their uncapped users started this ball...

Personally i am a big fan of good dvd/video rental shops.
I really try look for stuff to rent and watch and if i cant find it then i`ll download it
if i want to really check it out. I don`t want 50 billion dvd`s lying all over my house anyway.

Is there is thread for good DVD rental places with tons of stuff ?
since it looks like my Portal2Privacy is under threat
There is a places like Gas lite in menlo park/brooklyn etc.

Go into a shop, hold them up at gunpoint and steal a couple of hundred thousand Rand. Take that money and legally buy all the **** you have been downloading. Problem solved. Armed robbery is less risky than downloading copyrighted material in South Africa (according to this article).

How about this example. They play a song on the radio for free, I tune to it and listen to the song. Nothing wrong. But as soon as I store that song, it's considered piracy. Considering in the eyes of the law it's a hefty fine to distribute songs, surely in this case the radio company will be fined for piracy?

The Radio company has a LICENSE to broadcast and they pay ROYALTIES. You have neither. Sorry, not a good example.

But yeah... I agree ... what the content owners are claiming is really stupid.

Strange logic on your part. Radio station abides by the law and their commercial agreements and you want them fined when you break the law / commercial agreements.

Nope. They pay royalties for all music they play.
