Internet Piracy: What happens in South Africa when you get caught?

What if I only download songs that I also have on tape (recorded from the radio). That seems legal.
 
The Radio and Television with VCR and cassette`s (magnetic storage) is to blame for all of this :D

I remember as a kiddie we taped everything we liked on any mediums, even
after they introduced jingles on 5fm etc. and we used to listen&watch those tapes
to pieces.

xx years later still have the same trend, still magnetic storage but now we just copy and paste.
And they still produce massive volumes of media in-fact much much more and still tell us the same
old story as way back then... How they now have to buy the standard humvee since they can not afford the golden one any more :p

While the Copyright Act of 1978 makes an outlaw of anyone who has ever ripped a CD they own to their PC or copied a song from their PC to a portable music player, it also protects the rights of artists, authors, software developers and other copyright holders

You are not allowed to make a copy at all even if you own the original (unless the owner of such copyrighted material give you permission ofcourse)

You are not allowed to record any publicly broadcasted material in this country either.

But what if it is in my head, and I listen to it in my head the whole time? Or must I try to forget it?
 
Luckily, I have the valid DJ Licenses that allows me to download any music content I want to, use them at my Gigs and have SAMPRA pay royalty's on my behalf. It is a bit pricey, but its worth knowing your ass is covered.

how long have you had this.... and in this time... how many times have you been asked to physically give proof of your license?

I have never been asked to produce my Licenses while at gigs, however it is there if needed. People already know I have them so nobody asks.
 
How do they track that?
Have you ever seen, that sometimes someone on MyBB posts typical letter: "Received copyright infringement warning letter"?
Was reading around, seen an article on P2P, where some guys learned to determine almost exact addresses of peers (that seen on a list, when using torrents).
They say, just take addresses from that list, and you already have idea, where download/upload coming from...
I don't think it will work, unless recording companies make huge investments.... :rolleyes:

I fear that we don't have resources to do that.

This is a FAIL article. Firstly you cannot just look through someones computer (with warrant) and say "Mmm, this looks like copyrighted material". What if I recored it off the TV or other broadcasts? Or if I owned it at some stage and the original got lost?
Secondly, how to you bust someone in the act of distributing copyrighted materials? You will first have to proof that what is being distributed is indeed copyrighted material and then you will need to proof it is being distributed to someone that does not hold a right to the material?

Explain to me how on earth are you going to do that taking into account cross border transfers via encrypted peer to peer connections ?

Didn't read the article did you? Yes, these have to be proved. Just because something cannot be proved doesn't make it legal ;)

I was just about to add something similar.

Bail on killing someone: R1000
Bail on raping someone: R500
Bail on robbing a house: R300

Now I know quite a few guys selling their wares on the street, and every few months the cops come and confiscate the material. But no arrests. No fines. Nothing. A week later they're just walking around with selling the same DVD's again. Nothing happens to them. But it seems that the minority are at focus here. The minority (you can figure out for yourself who I'm talking about)

Strange logic on your part. Radio station abides by the law and their commercial agreements and you want them fined when you break the law / commercial agreements.

South African law criminalises those who distribute copyrighted content without the permission of the copyright holder.

So the radio company has legal right to distribute it to me... and I've stored that distribution. I see nothing wrong. How can you fine someone who copied a song if they didn't know it was copyrighted?
 
Until SA downloaders start getting arrested, charged and convicted, I wouldn't worry about any of this. It's all just scare tactics.
 
they should be spending time getting the rapests,murders etc off our streets before they focus so much on this crap
