Is it possible to have my name as the owner of the car

Hi all

I need advice and help , I live outside the country most of the time so my question is:

I want to buy a Taxi as I said in my other thread but i want the ownership to be in my name even though other documents like permit, insurance and tax will be in my drivers name.

Is it possible or not? If it possible how the process works any advice.

Possible.
Insurance -> He is the primary driver.
PDP -> Taxi Driver
Taxi Permit -> Registered to Taxi albeit I might be wrong.

No.

The permit is issued per vehicle (registration number). So if you are the registered owner of the vehicle then, by extension, the permit is made out to you.

When you buy the permit (as I remember you mentioning) you will have to provide a tax clearance certificate before they register the permit in your name. So again, you'll be linked to the tax for income generated from that vehicle.

Your driver can pay the insurance.

What YY says makes sense. That is because the contract for conveyance is between you the taxi owner/permit holder and the commuter. The driver is merely your employee.

If it were an ordinary private vehicle not used to convey people for money, then anyone can own the vehicle, even a one day old baby (assisted by its guardian, of course).

or i can have the permit and the car reg in my name since i will be the one responsible for paying tax on the income generated from the taxi.

I am now getting confused because i know some poepl who live abroad and still own taxi business in SA.

AS i said before i do trust my partner in business i am still not sure having all the paperwork in the drivers name will be a good idea.

if there is not other way then that will be my last option fingers crossed that the trust will be mutual on both sides :)

You can still have everything linked to you and live abroad. I think your issue here is you do not want accountability and responsibility.

Be cautioned, however: if the permit is indeed made out in your name and you're not attending the association meetings because you are abroad, the association has the right to apply to the Transportation Board to have your permit revoked. This is because they'd have no way of knowing whether you're in fact still operating or perhaps dead, etc.

How do I get everything linked to me , me and the driver we are 50:50 share so for the permit I think it would be good to put the drivers name since he will be able to attend the meetings.

Please how can I have everything linked to me since i live abroad if you can help with infor that will be great.

I am trying to make everything fair on both parties.

Lets be clear on one point.

If the car in in your name(registered), only you can hold insurance on it. I.E the person with the monetary interest in the car must initiate the policy.

You can however list him as the primary driver. Premiums will be paid by you. insurance policy will be in your name.

Not exactly sure what you're trying to achieve but...if you've put up the cash for the car and want to protect your "investment", but don't want the frustration around the taxi permit issues:
Put the car in his name, he is listed as owner, you are listed (on the logbook) as titleholder as a bank would be when a bank finances a vehicle. You hold the logbook, not him.
He cannot sell the car without your release etc.

With above, he can have the insurance/permits/etc in his name.
Again - not sure if this helps - depends on what you're wanting to achieve.

Thank you everyone and @gogo i will put my name on the log book i think thus a good idea and leave everything into my drivers name, so that i do not complicate things.

Of course, since etolls is a "Owner Pays", and not a "User Pays" system, the registered owner will have to pay etolls.

Only physical toll gates can be "User Pays".
