Is this lawful...giving a raise to selected employees?

I work for a small IT company where I'm not happy at all. Last month my employer gave a certain few employees a raise and left out about 30% of us with neither a raise nor an explanation as to why we didn't get any. Is this lawful to discriminate like this, to add on that none of the women at the company got a raise.

I am livid as I know I'm damn good at my job. Is this just a case of unfairness or is it unlawful?

Possibly neither. Ask them for a discussion about performance vs expectation. Compare notes so to speak. You say you did a damn good job, they say no raise (which = a effective decrease after inflation)...clearly there is a difference in opinion on "performance vs expectation".

Is giving different levels of raises to different levels of performers discrimination?

Thank you for your responses guys, I did guess that there was nothing I could do legally. I guess I just have to suck it up and start searching for a better deserving and appreciative employer.

Havoc I sure will request to have a discussion to clear the points you raised.

It depends, if there are clear rules on how performances are measured and according to that you didnt get a raise then that is correct. Through performance management you are suppose to get feedback on your progress and areas that need improvements. So go get the feedback.

However, if there is no performance management process and the boss just thumb suck and give out raises to his/her pet people, he/she might be in trouble. Best is to speak to a labour laywer or CCMA. But try and resolve it before you go this route.

100% allowed.

suck it up, they hate you

I agree. It is allowed but you don't necessarily need to suck it up. You could try to find out what labour rights you have at your workplace and decide if you are willing to go "against the flow" and stand up for yourself.

Or you could just "suck it up" and accept that "they hate you". The difficult part is to stand up for yourself in any workplace these days, believe me when I say that I know.

This is what I meant.

I've stood up many times...and it has NEVER ended well (for me).

Regards,

I stay in Johannesburg. I'm currently the IT support manager, also doing my honors in Information Systems to improve my prospects for better opportunities.

It's better just to move on elsewhere, not worth fighting it. I would still request a performance evaluation & feedback session though.

I'm telling you, get your focus even into the orange, just the orange...
And I guarantee you can have a chair like that. And an office like this. And a piano-shaped pool if that's what you want.
It's all there for you. All you got to do is focus. Just work a little bit harder.
