If an internet re-seller buy web and email services from a ISP wholesaler , and the re-seller store all mail on the server that he rents from the ISP, is the ISP allowed to access the re-sellers email for what ever reason.

Where can I get more info regarding the ISP law if there is any.

I can’t think that ISPs have the time to go and look at someones mails.

If it is POP/IMAP, it is easy, Exchange is a bit more difficult.

Depends on the security setup.
Some are highly encrypted.
Others are not.

But I believe:
That even if the ISP is able to view it they should not. POPI act and all those things.

that should be in their t&c of the reseller agreement

usually only when the law requires them to access the information do they do so.

Probably highly unethical but possible. The server logs should indicate if that happens though?

You could also use an encrypted email package which will make it neigh impossible for them to casually browse through the emails.

I am certain they would have to request permission to do so...perhaps under a court order it could be possible without permission or consent.

If you are uncertain, contact ICASA - https://www.icasa.org.za or the Information Regulator - http://www.justice.gov.za/inforeg/index.html
