Here we go again.

  • New offences – Includes the distribution of a data message of an intimate image, the infringement of copyright by peer-to-peer sharing, and sending hate speech messages.
So hockey mom would be a criminal now ?

Once again a bunch of FUD and nonesense.

Copyright cannot be 'stolen'. It can, however, be misappropriated in terms of the Copyright Act. Downloading and possession of pirated material is not a criminal offence in terms of the copyright act and "theft of incorporeal property" will not apply in this case.

The new act bundles incorporeal property under the common law definition of theft, which requires intent to permanently derive the owner of his/her ownership. Downloading and watching a pirated movie will not be covered since you are not taking away anything or depriving the creator of his/her ownership. Wearing a pirated t-shirt from China will not be covered.

This attorney firm is dead wrong in their interpretation and I highly doubt services providers even has a legal obligation to report a person downloading movies, music or games. Distributing perhaps, but definitely not downloading.

And the definition of 'an intimate image' is ?

A couple hugging on a park bench is an intimate image.

Who wrote this bill ?

I do not even care about this. This is another law that will fall flat on its face. But, on a more serious note, they better get more experienced people in there to help with these tasks.

They cannot even get RICA or FICA right. Banks still fail to report multi-million rand suspicious transactions. But now ISP's are going to report non-kosher movie downloads? :laugh:

I thought piracy is a civil matter why are they even considering jail time. Will these pirates be placed next to rapists, child molesters and serial killers?

Which, by the way, is still not illegal. Not even under the amendment bill :) So, still not sure how these attorneys deduced this.....

The Select Committee on Security and Justice has invited comments on the incoming Cybercrimes Bill.

BusinessTech reported that the latest version of the Cybercrimes Bill differs “quite substantially” from previous versions.

Time to go back and report all the staffwriter's adventures of trying x and got away / brag about crimes thread. Oh wait the ISPs will cover that too.

cANCer has been caught stealing every year for last 24 odd years.
They have taught us voters to follow in their footsteps.

Fix your kak stealing pilfering crap inhouse first before you come to us for piracy. This is yet another example of those konts who are breaking the country to distract our attention of what the real problem is. A very common tactic that is used every single week in RSA. :thumbsdown:
