Jailed FMF activist argues ‘unfair trial’ after magistrate calls black lawyers ‘you people’

Cekeshe believes his lawyer’s level of experience and utterances made by the magistrate presiding over his case negatively affected the outcome of his case.


The only Fees Must Fall activist that is still behind bars has petitioned the high court to appeal his conviction on the grounds that his lawyer was unprepared and inexperienced and alleged that the magistrate who presided over his case had misdirected himself.
According to a report published by the Mail & Guardian, Kanya Cekeshe, who has been in Leeuwkop prison since 2017, filed a petition in the Johannesburg High Court last week.
In it, he alleges that his lawyer was “wholly unprepared and inexperienced” and claims this, among other reasons, led to him getting an unfair trial.
Following the height of the Fees Must Fall protests, Cekeshe was sentenced to five years in prison for public violence and malicious damage to property.

This after he set a police vehicle on fire during one of the protests in 2016 – a charge he later pled guilty to.
In his application, Cekeshe recalled how he was handed paraffin by a fellow protestor and proceeded to douse the SAPS vehicle in it before setting it alight with his own matches.


Cekeshe accused his counsel of continuously interrupting the magistrate, going on incoherent rambling rants throughout the trial and repeatedly showing up late.

our Constitution, who we voted for says, that every person must have a fair trial. But I agree. set him alight.

It was an unfair trial, his sentence was too lenient, he harmed so many other students due to his actions, causing tens, if not hundreds, of millions in damages through indirect actions (2015 for my uni we wrote exams in Feb 2016 due to strike actions, try and calculate how much that cost the universities, plus all the security they had to employ and the replacement of all the stuff, killing one "random" person would have done less damage to society, at least then we'd have an easy case).

At least we've had very little protest action these last two years, but unis and lecturers still make plans around an "in case", thanks to that BS, increasing load on already overstretched teaching staff.

So much harm caused an he only gets a measly 5 years. I bet the moment he's done ANC or EFF while hire him.

He also doesn't seem to be showing any remorse for his actions.

Does the use of the term make the trial unfair and does it negate his guilt?

Yes the judge should not have said it... But this little fscker needs to suffer the consequences of his choices and that should be jail time.

You people could refer to rioters, it could refer to legal counsel, used in addressing a collective. But yeah it's 2019 and automatically it's now lacist...

Yes, 'you people' is now a silly argument. Then this same motion should apply to 'boer' which wasn't determined to be racist. It was used in the very same context. Silly.

It is always the fault of the other guy when it comes to these dumbos.

I bet he would plea his case in court that its not his fault the paraffin was handed to him, he simply tried to put it down somewhere nearby and the only option was a police car. Then by accident as he tried to light his cigarette he threw the match on the paraffin and set the car alight.

Just all extreme case of bad luck. He should be called the real Lemony Snicket's A Series of Unfortunate Events.

i am not talking about the article..just the term in general. whether its "you people" as in young people or "you people" as in black people its a no from me.

That's nice...

You people is a perfectly acceptable usage of the language for a generalization... Context obviously matters in its usage.. But if you default to it being racist or agist or whatever upsets you... It's your problem really...

I believe that the judge used "you people" refering to the barbaric savage rioters - they can be found in all hues, but in this case the race card will be played.
