Among the slew of potentially destructive policy changes the Trump administration is rushing to implement on its way out of power is a rule that would authorize the return of electrocutions and firing squads for federal executions, an effort critics slammed as a twisted priority amid deadly public health and economic crises.


ProPublica reported Wednesday that the rule, first published in the Federal Register by the U.S. Justice Department in August, “has raced through the process with little notice but unusual speed—and deadly consequences.”


“This rule could reintroduce firing squads and electrocutions for federal executions, giving the government more options for administering capital punishment as drugs used in lethal injections become unavailable,” ProPublica noted. “The Justice Department surfaced the proposal in August and accepted public comments for only 30 days, instead of the usual 60. The rule cleared White House review on Nov. 6, meaning it could be finalized any day.”

Given Biden’s stated opposition to the death penalty and promise to work as president to bring about its end, it’s possible that the Trump administration’s rule reviving the firing squad and electrocutions will “never be put into practice,” ProPublica noted.

The use of Trump’s signature CAPS LOCK certainly added to the email’s air of authenticity. So did the hurtful reference to my being in the bottom 1 percent, which I believe to be the polar opposite of the percent that he cares about.

Next, the email laid out my own sad personal box score, listing my email address and the fact that I’ve been a donor since “not available.” Add that to my 2020 Campaign Cycle Gifts of $0 and my “Lifetime Total” of $0 and you can see why the big boss’ people might not be pleased.

“President Trump REALLY needs you right now. Why haven’t you stepped up?” I was scolded by the email. “ The truth is, we are pacing BEHIND our Election Defense Fund Goal. If we don’t so something quick, we risk LOSING America to BIG GOVERNMENT SOCIALISTS.”

The Washington Post editorial board slammed President Donald Trump for “leaving the White House just as he entered it: a total disgrace.”

In its opinion piece published Wednesday night, the newspaper tore into Trump for pardoning Michael Flynn, his former national security adviser who pleaded guilty to lying during the Russia investigation. The editorial said “we can only hope” the pardon “will be his last official degradation of his office.”

The board, a frequent critic of the outgoing president, said that “at least for a couple more months” in Trump’s America “guilty is innocent; lies are truth; traitors are patriots.”

But the question “is not whether Mr. Trump has degraded the presidency,” it continued. “The question is how much long-term damage he has done.”

“Will future presidents now feel free to use the pardon power — or the other vast powers of office — with such nakedly crooked motives?” the board asked. “How many will calculate that they can make corruption appear to be patriotism as long as enough of the country wants to believe the lies they tell?”

“President Trump phoned into a meeting organized by Republicans in Pennsylvania Wed., baseless claiming that the election was ‘rigged’ and falsely claiming that he won it ‘by a lot,'” the Fox News ticker reported. “Most of Trump’s legal efforts to challenge voting procedures in PA, MI and other states have been thrown out and his campaign has not produced sufficient evidence to back up claims of widespread voter fraud.”

The ticker continued: “At the hearing Wed., Trump’s attorney Rudy Giuliani claimed Trump had potentially won VA, when in fact the state’s vote count shows Trump lost VA by over 450,000 votes.”

According to the Fox News report, “states where the Trump campaign has contested results, including GA, MI, PA and NV, have all either certified or moved closer to certifying their results in the past week, further confirming President-elect Joe Biden’s victory.”

Details of that case are quite a bit more complex than that. There is a lot that is wrong with it.

The conduct of the judge for example is exceptionally dodgy.

On May 12, U.S. District Judge Emmet G. Sullivan ordered a hold on the Justice Department's intent to drop charges, saying he expects that independent groups and legal experts will wish to intervene. Judge Sullivan said he will set schedules for filing "friend-of-the court" or amicus briefs.[157] On May 13, Judge Sullivan appointed John Gleeson, a retired U.S. District Judge, to act as an amicus curiae "to present arguments in opposition to the government's Motion to Dismiss" and to "address whether the Court should issue an Order to Show Cause why Mr. Flynn should not be held in criminal contempt for perjury.

One week ago, the U.S. Supreme Court issued a 9-0 decision, authored by Justice Ginsburg, that took judges to task for similar amicus antics. Her opinion for the Court in U.S. v. Sineneng-Smith upbraided the U.S. Court of Appeals for the Ninth Circuit for violating a basic aspect of legal proceedings called the “party presentation principle.” In a nutshell, this concept dictates that judges must decide the case as presented by the parties before them. They are not to go out questing for dragons to slay (or issues to tackle) that the parties have not brought before them. As J. Ginsburg put it: “[C]ourts are essentially passive instruments of government … They ‘do not, or should not, sally forth each day looking for wrongs to right. [They] wait for cases to come to [them], and when [cases arise, courts] normally decide only questions presented by the parties.”

In other words, it is not for the courts to look for people to oppose cases.

Judge Sullivan’s actions this week raise serious doubt whether he paid attention to this recent, unanimous decision. Let’s rehearse. First, the Ninth Circuit solicited specific amici. So too, J. Sullivan has now appointed former prosecutor and judge John Gleeson to oppose DOJ’s effort to drop the case and essentially represent DOJ’s former view of the case. And he has opened the door to a flood of amicus curiae briefs from special-interest groups hostile to Flynn. Second, the Ninth Circuit suggested particular arguments for amici to make. Likewise, J. Sullivan has instructed Mr. Gleason to explore a possible perjury charge. Last, the Sineneng-Smith panel decided the case on an issue not presented by the parties. J. Sullivan has not issued a ruling yet, but if he does anything other than accept dismissal of the charges, he will duplicate the Ninth Circuit’s violation of the party presentation principle. Hence, he is coming perilously close to completing the very trifecta that drew the Supreme Court’s wrath against the Ninth Circuit.

Just on the conduct of that judge alone, Trump did the correct thing by pardoning Flynn. The state filed a motion to drop the charges. It is not the job of the judge to find someone to oppose it and then bog it down in legal shenanigans.

President Donald Trump refused on Thanksgiving to say if he will attend President-elect Joe Biden’s inauguration, didn’t rule out a run for the White House in 2024 and said the Electoral College will make “a massive mistake” if it formally votes for Biden on Dec. 14.

“It’s going to be a very hard thing to concede, because we know there was massive fraud,” Trump said, repeating false claims in comments to the press after a teleconference with members of the military. “This was a massive fraud, this should never take place in this country. We’re like a third-world country.”

The president said he wouldn’t comment on his attendance at any inauguration event on Jan. 20, adding: “I know the answer to that, but I don’t want to say it yet.” When pressed by reporters, Trump said that he would leave the White House in January.

“Certainly I will. … Certainly I will, and you know that,” Trump said before adding, “There will be a lot of things happening between now and January 20th, a lot of things.”

Donald Trump lashed out during a Thanksgiving press conference at a reporter who pushed back against his false claims of election fraud, calling the journalist a “lightweight” and telling him, “I’m the president of the United States.”

Reuters White House correspondent Jeff Mason asked Trump if he will concede when the Electoral College votes for President-elect Joe Biden.

“Well if they do, they made a mistake, because this election was a fraud,” Trump replied, before launching into a tirade about the number of votes Biden got compared to former President Barack Obama.


When Mason interrupted this lengthy digression, Trump snapped, “Don’t talk to me that way.”

″You’re just a lightweight. Don’t talk to me that way. I’m the president of the United States. Don’t ever talk to the president that way,” he added.
