SARS right to fire employee who called in sick to attend EFF march, judge rules

A SARS employee, who was spotted “singing and clapping his hands” at an EFF protest march in 2020 when he was booked off sick, has been dismissed.

Johannesburg Labour Court Judge Graham Moshoana has set aside a previous ruling by a Commission for Conciliation, Mediation and Arbitration (CCMA) commissioner that the dismissal of junior investigator Benneth Mathebula was substantially unfair and that he must be reinstated and get back pay.
 
Cue Malema calling SARS white capital and marching to destroy their branches..
 
We are at a point where the ccma should just be ignored and then whatever judgement they issue taken to court. Another bunch of clowns.
 
Some real dumb people in high positions in this country.
Like this CCMA Commissioner and the police captain that spotted Faf in Japan all the way from Stellenbosch.
How do they get appointed. Is stupidity a requirement.

We once had an employee steal from us multiple times. He was caught when he tried to sell the stolen goods to a 2nd hand store, the store saw our company logo and phoned us to see if the goods belonged to us. They confirmed that it was the employee that tried to sell the goods to them, and had taken a photo copy of his ID. There was no mistaking it.

We fired him. He took us to the CCMA for wrongful dismissal ... and won.

That was the moment I knew the CCMA was a useless entity that only served to further poor employee performance and entitlement.

While I dislike the American labour laws where you can pretty much be fired on the spot for almost any infraction and receive no severance pay*, it might be what we need in SA for a while to set peoples entitlement mindset straight and make them appreciate they have a job, if not a career.

*This is based off watching too much TV. I have no real-world knowledge of how the US labour system works.

I have friends who had a similar thing happen and its ridiculous. But then you look at the so called leadership and stealing is seen as an acceptable thing to do.

The TV is not wrong.. It's called at-will employment.. however, there are some exceptions and at least one or two states where this can only happen during 6 months probation period.. others states will have a public policy exception where you can't fire someone because they had to do jury duty for example.. another exception applied in some states is employer acting in good faith, like not simply firing someone because they have a large bonus due to avoid having to pay the bonus..
 
3 years to make a ruling - the wheels of justice...
