I am not sure, what class action means and my legal knowledge is limited, but my thoughts are that at least we can collectively claim breach, and ask for a remedy
As no other method seems to be doing anything, we may find that an attorney letter might do the trick....requesting remedy, to take place immediately with some form of compensation ie: letter of apology, new contract, AUP and a refund of extra bandwidth purchased.
What are your thoughts?

yeah sounds good, class action means basically that a group of us make the claim, so exactly what you were thinking by the looks of it. I think it could work, but we'd need a group of us and a lawyer willing to do it pro-bono since we're all cheap bastards. Give em a call, or fire off an email, lets see if we can get the ball rolling, or perhaps those affected could send a template email to show its a problem with more than one user. More than one user = publicity and publicity = free lawyer

ok, i mailed a local dbn based firm asking for a referral for a jhb based crowd.
coz of costs... in the meantime we got to get that poll going so we can se how many peolpe are involved.
Who sets up the poll? RPM?

Another option should be:

-Disconnected in April and continued to exceed the 3GB cap, but haven't been disconnected in July, yet.

but the reasoning behind not having that option is you tick that today right, and tomorrow you get capped and it happens to you and you cant update your vote.

I agree with Slimothy. I'm 400MB away from getting capped, and my experience could change overnight. [It might just, if I decide to test the theory]

ok, so we make a template upload it and anyone who wants to lodge can use it?
but we need some idea before asking an attorney, as to numbers!!

ok so then if anyone would like they can pm me with yes i would like to join the class action.........and i leave the option open to decide.
If we have enough peole we can get details later on that basis.

otherwise they dont need to say anything

IANAL but AKAIK there is no such thing as a class action suite in SA. Ask dominic, he should be able to tell you whats best here.

I agree re: your post,ie: the problem is that by the time this poll is polled ye the bandwidthfromhell has changed shape again.

Myself i have about 250megs before i am capped again, I also dont know what the outcome wil be when I am capped.

I hope though that even if we get 20 users who have already been capped and had to purchase, it would be enough to start someting.
The history is something that even WBS CANT CHANGE
Its cool i think, lets just wait and see what response is like.....
