Eskom guilty of unfair discrimination against white employee

The Labour Court found that Eskom practised unfair discrimination against a white employee who had been with the company for over 30 years.

The case stemmed from a complaint by Eskom employee AP Erasmus, who applied for a new managerial role in the company’s technology division.

Not sure when he applied. And, I'm not going to go check the dates, but the way things were during the Zuma years - There was probably a lot of news leading up to elections, about how RET was being championed at Eskom. Lots of populist rhetoric.

I don't think people always remember, but the RET faction was fairly in-your-face about all these things all the way. Anybody who complained was called racist. Our current "fearless leader" was the head of cadre deployment at that time. Quiet as all heck, but right there in the thick of things.

"The court ruled that Eskom’s practice of excluding non-designated groups, including white males, from job shortlists constitutes an absolute barrier"

Makes f**kol sense.
We have a discriminatory BEE law yet you're not allowed to discriminate.
Pick one.

Also, please can we now sue the snot out of each and every private company out there that pulls this stunt daily.

I read it as you, Eskom, the ANC state whatever is allowed to discriminate but they just have to follow the rules made by the ANC regime. Very like; legally apartheid laws could be enforced as long as konstabel adhered to the law. If it didn't and now doesn't have the desired outcome of racial discrimination, change the law.

Yes I read it as they just dropped him off the list because he was white and did not reject because they selected a BEE candidate instead.

Yes, the position is still empty with no one to fill it except whitey so it remains empty. Its not like Eskom needs to function properly or anything, they always have taxpayer to bail them out.

Applying for a position vs applying for a job

Those that are there for the salary and benefits, not to perform a task for compensation (doing the job). The OEMs can keep themselves occupied with getting on with the job

The court ruled that Eskom’s practice of excluding non-designated groups, including white males, from job shortlists constitutes an absolute barrier.

Excluding non-designated groups, including white males, breaches South Africa’s affirmative action laws.

“Eskom must take remedial steps to ensure that the said practice ceases,” Judge Hilary Rabkin-Naicker said in the ruling.

I mean it is only a little bit of racism between friends. Pinky promise, it won't happen again.

Solidarity needs to be pushing harder on liability. All of the people responsible for making this decision should be fired for engaging in racism.

We only need OEMs because of this BEE/AA/Transformation s**t.

This kind of stuff just hurts the entire operation. ANC are stupidheads. Their insane pan africa bs will cost them everything.

BEE looks like it'll buy you votes, maybe it even did in the past, but in the long term (today), it's political poison.
