Late joiner penalties and medical insurance

Are medical insurance companies like One Plan legally allowed to charge late joiner penalties?

Yes.. for the time being** but its up to you to shop around and additionally decline and show when its not applicable*.

* Late Joiner Fee is for people joining a scheme after age of 35 with no prior history of medical aid or cover has previously only started after 35. Years covered prior to 35 can be banked where primary or adult dependant. e.g. having cover from 28-30 and re-joining at 37.

** Late Joiner Fee is currently due to be debated with other NHI laws.

This applies to Medical Aids - Medical insurance is not covered under the Medical Schemes act so they can pretty much do what they want
