lawyers in the house???

I cancelled my subscription about a month and a half ago but I was still able to connect to iburst this month. Money was not deducted from my account due to the fact that I unsubcribed. I used up around three and a half gigs of bandwidth this month. My reseller is now "requesting" that I pay my R599.00 although it was wbs and their duty to close the network connection.

If there are any lawyers here or people who know lawyers what are my legal rights???

There are a couple of them around. One of them I know is a great man, the rest seem to only respond if they feel threatened. However, there could be a couple of them around who post but who are not public about it when they post.

Yeah I'm pretty sure IBurst could argue that since you used the service it's your responsibility to pay for it. I dunno though... *pokes lawyers*

yeah... thats like going to a shop and taking something off the shelf and using it/eating it because it's there and then crying like a baby when they ask u to pay.

more a moral question don't you think?

it would probably play like this: you had a contract and you used the service + you terminated your subscription i.e. stated you did not want to use the service anymore + you carried on = an implied contract (i.e. the very fact that you were using the service creates a contract between you and the reseller - they provided and you used) and imo that would entitle them to firmly request payment

R599 is not an amount i would fight about if i was probably not in the right

Yeah pay your bandwidth bill. We pay ours and Gigs are scarce enough as it is!

Thanks for the feedback guys one more question. So because I used the service I am obligated to pay for it.
Now the next question is.
It's the 20th of the month I have been disconnected because I am 500 megs over the 3 gig limit (keeping in mind that my download speed should now be reduced to 64kbps till the end of this month) . Should I pay the full R599.00 or just pay for the days used.

Now that's a difficult question - if you have been cutoff/disconnected then IMO the implied contract that Dominic referred to, was terminated by the other party [i.e. either WBS on their own, or at the request of the reseller], it would appear you will need to negotiate a settlement amount...
