Man jailed for over two years after killing hijacker — sues police for R2.6 million
A victim of an attempted hijacking, who shot and killed one of his attackers, spent more than two years behind bars because the police suppressed evidence from the prosecution that he had acted in self-defence, the Johannesburg High Court has ruled.

The police officers involved should be sued in their personal capacity, I don't know how exactly but until police officers actually feel the consequences of their actions (or inactions), nothing will change.

While true it is largely irrelevant, the purpose of suing the officers in their personal capacity, would be to try and get them to take responsibility for their actions and hopefully get them to change their ways. As I said, I don't know how or if this could be done, but suing the police for damages is all fine and well but I believe it does very little to change the police's abhorrent behaviour.

it is very relevant, because the applicant would be interested in actually getting the cash to compensate for damages done

suing them in their personal capacity will do very little to change behavior if they have very little assets to lose, infact it may increase reckless behaviour

your argument is on shaky grounds
 
He won't get 1c from the minister. A friend's wife was held by the SAPS in George for 3 weeks without them informing anyone, then lied about how she had attacked their officer. She weighs 42kg and has a small build and a damaged right elbow

The SAPS contested the case, but she was awarded R810k. They have not paid, citing a proposed appeal, That was in 2017. There has been no appeal

The SAPS take 9 months to reply to emails and give half the answer, in bad English
 
R2.6m isn't enough. This sounds like everyone involved failed at justice from the magistrate not granting bail to the prosecutor not getting a written statement as there was numerous opportunities for his version to be heard. They should all be fired and banned from law enforcement for life.
