Man jailed for over two years after killing hijacker — sues police for R2.6 million

the police officers probably don't have 2.6m in their personal capacity...
State can provide them with a loan. While paying it off for the rest of their career, they will think twice about whether they can afford another loan...

all the best trying to get that past a judge in a civil matter

and even if a judge were to allow that, the loan will be unsecured and the police officers just default, resulting in the state paying in any event

try again

WHY !!!!!!!!!!!!!

why are they hiding evidence in these types of cases? what is the reason ? it makes no sense

R2.6million of our tax money is nothing. Should at least have been 26 million + everyone involved in this case locked up.

"police suppressed evidence from the prosecution that he had acted in self-defence"

So, what's going to happen to the SAPS members that did this..............................nothing as usual.

it is very relevant, because the applicant would be interested in actually getting the cash to compensate for damages done

suing them in their personal capacity will do very little to change behavior if they have very little assets to lose, infact it may increase reckless behaviour

your argument is on shaky grounds

We'll have to agree to disagree, I never said that the police shouldn't be sued for damages, I merely said the officers involved should be sued in their personal capacity. I still maintain that suing the police alone will not change the officers behaviour in the future, suing the officers in their personal capcity might though, although I don't know how the process would work rr if it is even possible.

you are completely ignoring the plight of the person who spent two years in jail

whether they are compensated in full or not is irrelevant to you and your pitch that policeman might change their behaviour is on weak ground

the bottom line is that if someone hasn't got any substantial sums of wealth, its pointless suing them, infact it may just cost the applicant money in legal fees

The only thing on weak ground are your reading or comprehension skills, your responses to my posts clearly show you either haven't read them properly or fail to understand what I have said, I have not in any of my posts said that the victim should not sue the police or be compensated.
