Court dismisses EFF’s application to appeal Trevor Manuel’s defamation ruling
The High Court in Johannesburg on Tuesday dismissed an application by the Economic Freedom Fighters (EFF) for leave to appeal a defamation ruling on former finance minister Trevor Manuel.

On May 30, it was ruled that the Economic Freedom Fighters (EFF) had 24 hours to remove statements about Manuel from all the party’s media platforms and that it should apologise to him after they were found to be “defamatory and false”.

Economic Freedom Fighters are not very economic.
Maybe they should change their name to NEF (Not so Economic Fighters).
SF (Stupid Fighters) or DF (Dumb *ucks) would be even better.

EFF TO TAKE MANUEL MATTER TO SCA

The High Court in Johannesburg dismissed the party’s application for leave to appeal an earlier judgment that found it had made false claims against Trevor Manuel.

The Economic Freedom Fighters (EFF) was planning to challenge the court ruling in its dispute against former Finance Minister Trevor Manuel in the Supreme Court of Appeal.

The parties state that the court erred in at least four respects, with regards to the awarding of damages. They contend that “the penalty chills free speech” and poses a threat to constitutional rights.

“Politicians, and those in the public eye who play a political role, are as a matter of course considered to have thicker skin than a truly private litigant," the party's papers read.

They also state that the judgment does not fit the injury and is “grossly disproportionate”.

Hmm, so let's agree then with them. Then find them guilty again. R2m penalty. Also another R2m for Julius in his personal capacity? Plus court costs and legal fees of the other side. Hmm, sounds good :)

Very novel... still going to fail though, since I would guess the onus is on the EFF to verify the information before stating it in public.

Not just that ...
In its May 30 ruling, the South Gauteng High Court found that the EFF did not take reasonable steps to verify the defamatory allegations in the message from their informant prior to publication and did not give Manuel a chance to comment prior to publishing their statement. As such, the court found at the time the EFF could not reply on the defence of reasonable publication.

All the EFF are doing is growing that R500k figure with all the legal costs of pointless challenges.
