Mkhwebane hearing: Court judgments are just 'opinions', says Dali Mpofu

Court rulings are just "opinions", and those against Public Protector Busisiwe Mkhwebane are "blatantly wrong", her counsel, advocate Dali Mpofu SC, told the Section 194 Committee.

The committee will decide whether Mkhwebane is competent for the position of Public Protector.

Mpofu represented Mkhwebane in some of the court findings against her.

Also, the previous day, Mpofu objected to a witness' evidence being led because, according to him, it didn't relate to the four court cases upon which the misconduct and incompetence charges against Mkhwebane were built.

In the end, the testimony of Baldwin Neshunzi did relate to one of the court matters, and also provided another piece in the puzzle of the State Security Agency's involvement at the Office of the Public Protector.

Agreed. He is a clown and you can see that. Should never have been admitted as an attorney in the first place.
He has won high profile cases in the past so, he's probably a competent lawyer with the ego the size of a small planet.

Never heard before that court judgements are just opinions and if you don't agree they're wrong opinions...
They are indeed opinions so there isn't much of a scandal about that. They do carry more weight than an opinion of a regular person on the street but they are still opinions, that's why a different judge can overrule the decision of an earlier court because his or her opinion would be different.

There is also nothing scandalous about him saying they are wrong, that's obviously his opinion which does not matter at the end of the day since the court is empowered to have made that decision, regardless of whether he agrees with it or not he has to abide by it.

You guys are full of drama, we might have a different opinion of just how good he is but the guy is certainly not a moron that you would compare to Hlaudi, he is a fully qualified and competent lawyer who has seen plenty courtrooms and won plenty cases.

If he is indeed such a moron what does that say about the DA lawyers he defeated when he was representing De lille or the Afriforum lawyers he ran rings around when he was representing Thandi Modise?

I bet he thought it was the brightest thing to ask.

Of course opinions can be binding if they are from a compent authority, lockdown regulations were binding on us even though they were simply opinions from those entrusted with authority.

Laws that are passed in parliament start as someone's opinion and end up as binding laws on us, we disagree with them all the time but they are binding nonetheless.
