I agree with you.She absolutely has a choice. Her problem is that she likely isn't used to dealing with a guy like Brooks who works with "street respect". Public defence lawyers deal with his type all the time and know how to talk to them. You have to be brutally direct and honest with them, no deference made for feelings. If she had done that in the beginning, he wouldn't be dominating her court room. He figured out instantly that she would never carry through with any threat.
Another problem is that she seems to be scared of the appeal court. Let the idiot appeal, she should be confident enough in her knowledge of and application of the court rules to apply them.
What I was trying to say is that she has to walk on eggshells for fear of being called a racist.
