Aarto declared unlawful — What happens to your traffic fines

Traffic fines issued in Johannesburg and Tshwane still remain valid despite the Administrative Adjudication of Road Traffic Offences (Aarto) Act being declared unlawful and unconstitutional by the Pretoria High Court last week.

That is according to a statement from the transport department's Road Traffic Infringement Agency (RTIA), which said that the Aarto Act remained in force until the ruling was confirmed by the Constitutional Court.
 
I think they just want the money
Of course. If you pay, you basically admitting guilt, remember something similar years ago.

So dont pay. Wait until the ruling. If Concourt finds that is illegal. Cool. If they find it was legal, then you can pay.

According to its interpretation of the ruling, the Criminal Procedure Act would take precedence once the ruling was confirmed.

That means the relevant authorities in areas where traffic police issued Aarto fines could still prosecute motorists for unpaid fines.

Let's wait and see if this happens. Somehow, I do not think so.
 
Got 2 fines in the post from the holy SAPO from 2019. So um i never got them. what now?

This is like asking the fox how to guard the hen house. That's not how the law works. The act is illegal. It remains so until another higher court overturns the ruling.

Yeah doesn't work like that...

You fined a person under a certain law, if that law is found invalid you don't get to just randomly change the fine to use a different law.
 
Court must also intervene regarding etoll aswell.

Seems the ANC interprets it the way they want to. If they do not like the ruling, like in this case, the illegal stuff remains in place until the appeal is done. If the ruling suits them, the illegal stuff goes away immediately, until the appeal is done.
