MTN Dispicable, makes me sick! Worst customer service ever!

My story is as follows:

We have 3 contracts with MTN. One which belongs to me, one which belongs to my mother and one which belongs to my father.

These contracts however, are registered under my mother's name ie. She is the account holder. We are trying to cancel my fathers contract due to the fact that he passed away last year November and his number is now not needed and not used at all.

MTN wants to charge me R5 500 for cancellation due to the fact that the Account Holder is my mother who is still alive and well. I find this to be completely dispicable, immoral and unethical. To me its as if they are charging a dead person because the number in question belonged to my father and NOT my mother. The fact that my mother is the account holder should not be a reason to charge an excessive amount of money for cancellation.

The lady on the phone didnt give a flying fsck that someone was dead. She was rude, obnoxious, and totally disgusting. (I wish I got her name).

How can I get out of this contract without paying this ludicrous R5 500 cancellation.

Am I being completely unreasonable to not want to pay R5 500 to cancel my dead fathers contract???


Please advise what I can do (if anything) to get out of this mess.

Your mother is the contract holder; it is immaterial to yours and MTN's business dealings that someone else was actually using the phone. Sucks, but you have no leg to stand on in that regard. The cancellation fee seems absurd at first, but if there was a phone included with the initial deal that likely explains the brunt of it.

While it may seem cold, a contract was signed. Even if your father was the account holder he would still be liable for the debt as part of his estate.

I can live with the fact that they want to charge for an early cancellation. I have no problem paying them a reasonable amount. Had they told me that in order to cancel we would need to pay R1 000, I would have happily done so. But R5 500!? That is cheek, that is unconsiderate and that proves that MTN doesn't give too hoots about its customers.

I have absolutely no words to describe how I am feeling right now. I am beyond angry.

those are the rules. apparently the service providers have found holes in the cpa that dictates cancellation fees and things so i dont know if there is a recourse.

as long as your mum is the account holder they are within their rights im afraid. the question of morality shouldnt enter a conversation about a mobile service provider.

This makes a huge difference to the issue...and it seems like the OP is avoiding the question.

Not avoiding the question at all, just had to rush to lockup my warehouse.

Was a phone included? I am not 100% sure. I know that we did receive a blackberry on the contract, but that phone was paid off after 2 years. We then extended the contract but we didn't get another phone because we already had a spare iPhone 4 to give my dad.

Quick calc. Lets say there was 18 months left of a 24 month contract and your mother is supposed to pay R305/month. That would give you R5500 cancellation fee if they did not penalize you mother. Simple maths and very legal.

Thats their terms and conditions, I suppose if your dad signed for the contract tten they would ancel it but seeing as your mum signed , the conditions still apply.

3) I came here asking for help, to see if there was anything I could do to get out of this mess. I didn't come here and asked to get mocked.
4) You have brought absolutely no value to this thread, while everyone else has atleast given me an answer (certainly not the answer I was looking for), they atleast contributed. You have not, so I have to ask myself this question. Do you troll these forums looking for people in need of help and mock them? If so, then I feel sorry for you.

Yeah, I also find nothing wrong with MTN's behaviour here. "Worst customer service ever" LOL

A similiar situation regarding contracts that I did have a huge issue with, was with Virgin Active refusing to cancel my ex-girlfriend's contract, despite the fact that she moved to a town where the nearest Virgin Active is 55 K's away. Ridiculous.

The contracts are under your MOTHER'S name, who is still alive and well. Why should they cancel it? Because you don't want to pay for it any more? Well I had a contract like that, I just had to wait it out. No special treatment. My ex-girlfriend's contact, who left me, and I didn't need it. ;)

They have absolutely no idea who "the number belongs to" all they know is who the account goes to and who signed for those documents...which is your mother.

Now talk to me about CellC insisting to speak to my father to make changes to his contract, who has had a stroke and is unable to speak on a telephone even though my mother has full right to sign on his behalf and the relevant documentation to prove it. Now that's shocking service.

Went through the process about 15 different times in almost two years to finally get the contract transferred to my mother's name and then finally cancelled because of their shocking service.

I have read that the first time, thanks, but it doesn't change the fact that she is the owner of the contact. ;) Do you not understand that?

Sorry to hear you had to go through all that. Atleast you cancelled and moved elsewhere.
