MTN's return policy on new phone (within the 7 day period)

Am I in the wrong, to return my new phone Sony experia E1, back to MTN and wanting it to be exchanged(not replaced)? Having serious battery drainages atm.

Since its a new phone dont you think it should get a few cycles out of it to get the battery optimal?
