This regulation also applies to photoshopped images and deepfakes, as well as pictures or videos which do not show the subject’s face but in which their identity is described.

The same is true of threats to people and property sent over WhatsApp, social media, email, or any other electronic communication.

For example, Malema publishes some threat made to him and or his members on social media. The threat contains a mobile number. The audience then goes and type the number into TrueCaller, CallApp or which ever caller ID app and then publishes said person or persons in public view. Caller IDs aren't accurate!!!

I will tell you now, there will be zero accountability, and things like this will continue to happen.

Let's be honest, as certain demographic's personal property is threatened daily on social media, but of course, that 'threat' is in the public interest.

Uhm... If ISP's have to log everything that is being sent on their network it would be an invasion of privacy of the user, never mind the impossibility to store these logs based on the amount of traffic sent by their clients. Imagine having a million connections with an average of 3 people per household (just an example) using the internet to send mail, Instant messages, social media etc etc etc all day. I just do not see that this could be feasible.

Just wait until memes are dragged to court, there are many themes with sexual themes and I doubt a judge will simply understand the background of the meme.

I can already see this legislation going back and forth in court. There will be people digging up old schit, and try to cycle it back into the public domain for malicious purposes, it is just the way some humans work.

For some a revealing female face is; while others think a man hopping around on all fours with fizzlers in his arse is.

An “intimate image” is defined as the depiction of a person (real or simulated) in which they are nude, their genital organs or anal region are exposed, or if they are a female person, transgender person or intersex person, their breasts are displayed.

These new laws were first drafted in 2017,
Plenty laws in SA .......... getting them enforced, not easy, getting a conviction - even more difficult.

Ask JZ or Juliass.

Going to be problematic. What's intimate to one person isn't to another. The covered reference is another bone of contention. Reasonable person tests have never fared well in a court of law. A better test has been whether a person in their state of mind has acted reasonably.

Then what constitutes consent? Is it ok to distribute a picture of someone streaking through a mall? What about a beach? Can someone revoke consent again after giving it?
