The ruling is very definitely not moot. Yes, no real private entity will appoint her as a director, but SOEs currently still can.

If she is declared delinquent then nobody can appoint her, period. By law if she is declared delinquent and is appointed, the board is not formed.

She still keeps her millions though.

The assumption is that the law is followed. Unless it's revealed in the media for joe public to have an uproar against, irregular appointments happen all the time in sa with the obligatory "oops" when discovered, which needs a commission of inquiry, followed by court procedures, etc, to solve. How many people know all the executives of ACSA, alexkor, or the national parks board? Out of sight and out of mind, weak corporate governance will enable this.

Advocate Carol Steinberg, legal counsel for the applicants, stated that one of the reasons given by Myeni for her inability to afford legal services was that she had been waiting for a liability insurance claim for SAA directors to cover the costs. It later emerged that the claim was only lodged last week Friday. Other reasons for her no-show include that she is not in a position to pay for petrol or accommodation to allow her to travel from her current home in KwaZulu-Natal to attend the case.
