If you listened to the case late last year you would know that President Malema stands of good chance of winning it, the police officer didn't cover himself in glory.

As regards Grootes vs EFF; I think they deserve each other and Grootes having his Niemoller moment; the twit.

The police officer covering himself in glory or not is ultimately irrelevant.

What matters is the CCTV footage, and whether that shows a case of assault, and from what I've seen it does. I think its at best a 50/50 for Malema and Ndlozi currently.

I honestly don't get how there isn't a legal precedent set for falsely accusing someone as a racist in today's South Africa! I am sure everyone is sick and tired of hearing how the EFF stays relevant purely based on the racial divide they like to cause and getting away with falsely accusing someone as a racist purely because they don't agree with someone. Maybe Grootes should sue them for false accusations based on undermining his personal dignity?

Why should Malema win it though, is he not guilty of assault?

Assault

Assault consists of unlawfully and intentionally
  • applying force to the person of another,
  • inspiring a belief in another person that force is immediately to be applied to him or her;
Assault with intent to cause grievous bodily harm. This is another form of assault, however, committed with the intention to cause serious bodily injury.

This video shows Malema and Ndlozi intentionally applying force:

I don't see what the debate is about

One is found guilty/not guilty in criminal cases. Winning happens in civil matters.
