The National Prosecuting Authority (NPA) is provisionally dropping its case against Gupta family members and business associates implicated in the alleged Estina dairy project scam in the Free State.

BusinessLIVE reported on Wednesday that the NPA had sent a letter to lawyers acting for the Guptas and their associates saying: “The state intends to provisionally withdraw charges against the accused on December 4.”

The provisional withdrawal was in the pipeline because the NPA had not received information about “mutual legal assistance requests made to India and the United Arab Emirates”. As a result, investigations could not be completed.

But the NPA told Business Day that the prosecution could be reinstated at a later date if the investigation was finalised and all outstanding information had been obtained.

The state had alleged that R250m intended for the upliftment of poor black farmers was siphoned to Gupta companies during the alleged dairy project scam.

Amongst those who had initially faced charges were former Oakbay CEO Nazeem Howa, nephew of the Gupta brothers Varun Gupta, former Sahara Computers CEO Ashu Chawla, Estina director Kamal Vasram and three Free State provincial government officials.

The Sunday Times reported in August that after costing taxpayers R220m — which allegedly went to the Gupta family — the failed Vrede dairy farm was to cost another R65m.

More than 500 cows had vanished from the Free State farm's 980-strong herd.

A turnaround plan aimed to increase the herd to 1,200 and plough millions into new buildings and infrastructure.

The plan was criticised by local residents who were supposed to benefit from the farm, now being run by the Free State Development Corp (FDC) and its subcontractor, E'tsho Holdings.

According to leaked e-mails, Atul Gupta allegedly scored R10m and the family allegedly bought a private jet and luxury cars with money from the project.

MLAT: https://en.wikipedia.org/wiki/Mutual_legal_assistance_treaty - they are seeking info from India and the UAE.

However, as far as I'm concerned, much of this is trying to un-spill water - the damage is done. The evidence is here in South Africa. It just needs to be worked all the way to a court, then the case heard even if in absentia. Extradition would be appropriate afterwards if they're found guilty.

However, as it stands, this is a nice cover story excuse for some of the others involved that are not in the UAE or India, rather still in parliament.

Chief Executive Officer at OUTA,Wayne Duvenage says this does not signal a lack of political will.

I think this was a case they rushed into. This was a very easy case when you think about it but they hadn't done their homework, their forensic processes hadn't really got to the bottom of it and you can't just go to court with a few bank statements.

I think they got a lot of egg on their face. They have got to regroup and get all their facts. They are undercapacitated and I think it was probably wise to withdraw it and regroup,formulate a very strong case and lay the charges properly. So they have probably done the right thing, I don't think it is a lack of political will.

Holy cow! Bank statements reveal how Free State government paid Guptas over R330m for Estina dairy farm

The bank statements show that the Free State Department of Agriculture paid the money over to Estina in amounts of up to R50m at a time.

The statements are for Estina's Standard Bank account, held at the Bedford Gardens branch, under account number 310864860.

Estina was supposed to run the Vrede dairy farm on behalf of the department.

The company should have ploughed the same amount of money back into the scheme, but statements showed that it never happened.

Instead, the money was paid into the company's Bank of Baroda account in India almost immediately.

The NPA cannot prosecute this? Seriously folks we South Africans are being taken for a ride by the ANC.
