No, what you don't get is that if you pull your firearm out of its holster, it must be with the intention to use it immediately. It's the law too. You cannot walk around with an unholstered firearm. Anyone seeing you can then legally shoot you as they have no idea of your intentions.

You come across someone with an unholstered firearm - What is your assumption? If you pull out your firearm and use it on him, you will be protected as if you assumed he was about to attack you or someone else.

How do you know if the criminal is armed or not? I can see his smile when you pull out your spray and he pulls out his firearm.
