It's illegal to carry a weapon that is unholstered in public. When it is out of the holster in public, the law states it has to be used. You come across someone with an unholstered firearm - What is your assumption? If you pull out your firearm and use it on him, you will be protected as if you assumed he was about to attack you or someone else.

Where the fukk does the law state that an unholstered firearm, HAS TO BE USED?

What if someone draws a firearm because of a potential lethal threat to him/her and the criminal then runs away?
Does the person then still HAVE TO USE THE FIREARM?
Or would it be OK to just holster it again without firing?

A while ago i had an incident outside my yard where i went up to a Gti and it's occupants with my firearm cocked, in my hands pointing, ready to shoot. They sped off without me pulling the trigger.
So if my neighbour saw me i'm the target ? And why do i have to use it ? I was just prepared.

If someone in another vehicle or anyone that didn't know you lived there saw that, you could have been legally shot. Plus face charges of pointing a firearm in public.

What exactly does the law say?
Is holding heat just in public to intimidate would be attackers qualify as using it? Pointing at some criminal or other considered use? Or do you mean if you pull out you must shoot something, anything?

If you unholster your weapon, it has to be to counter an imminent threat in self defence. If the person turns and runs, you are not allowed to fire. Someone shot in the back will result in a murder charge. Someone shot in the front will not if they are proven a threat.

I must have fallen on my head to understand CD, he's saying that if you walk around gun in hand someone might assume you're about to use it, if your neighbour sees you approaching a potential situation he'd assume you're being threatened wouldn't he? Unless he is a dumbarse.
