The end of spam robocalls — unless you give permission

The Protection of Personal Information Act, often called the POPI Act or POPIA, will prohibit companies from using automated machines to call people without their consent.

This is feedback from Ahmore Burger-Smidt from Werksmans Attorneys, who commented on the impact of the POPIA on spam calls.

Section 69 of the POPIA, which related to direct marketing by means of unsolicited electronic communications, states:

The processing of personal information of a data subject for the purpose of direct marketing by means of any form of electronic communication, including automatic calling machines, facsimile machines, SMSs, or email is prohibited unless the data subject—
  1. has given his, her or its consent to the processing; or
  2. is, subject to subsection (3), a customer of the responsible party.
 
Unfortunately the annoying Cell C robot calls still seem legal...
 
Oh please, it would be naive in the extreme to believe that POPI will have any effect on spam calls. Until the first company is actually prosecuted and made an example of, it will just be business as usual. Not many people in the industry believe that the information regulator has the means to actually enforce the POPI Act.

Probably won't end anytime soon. It is interesting, however, how many companies are emailing customers and asking them to opt out (or do nothing to continue receiving communications).

I thought POPI required an explicit opt in permission?

It would be nice if you could make up your own phone numbers. So the telephone company assigns you the first 10 digits, then you can append any 3 digits after that and give that unique number someone and it would still ring through to your phone but you could see the last 3 digits (think how the [email protected] works).

Then when you are asked to enter your number on any form or site you can give them a unique number, and write down who you gave that number to. Then when you receive spam calls, you identify the number, who you gave it to, and thus who they onsold it to. Then you just don't do business with that company ever again and blacklist that unique number on your phone.
 
I received so many POPIA consent emails today... Going to quote one send by chaos since it is in my private email,

As of 1 July 2021, compliance for the Personal Information Act, 4 of 2013 (POPIA) is coming into effect, and as a valid member of our mailing list, we wanted to take this opportunity to highlight the changes this brings.

Per new regulations, Administrators are now required to get consent from you to be part of our mailing list. As such, please note that you are entitled to not be a part of this mailing list, and should you so wish, you may unsubscribe yourself at any time from receiving any mail from this email address.

Should you choose not to remove yourself, it will be agreed that you consent to being a part of this mailing list. That your personal information (your email, cell phone number, name and surname), will be securely saved and handled by the administrators for administration duties and for the receiving of newsletters from this email address.
