Would it be possible to cancel a contract I have with Cellc if the web site shows full 3G reception in Midrand, yet no data throughput is experienced?

This has been going on for close to a month constantly. Just not getting any service.

Should be grounds for a fair cancellation correct?

Same here. I use my 8ta wifi in the house which was fine, but CellC 3g throughput is non-existent. Plus since my renewal, literally 75% of my calls get dropped. I can't even get through to a call centre because it requires a decent signal for more than 2 minutes.

This is literally insane. I can't believe they are getting away with it. I am sure you could take them to court and win if you had enough capital.

are there any lawyers on the forum who can fill us in?
clearly there are enough of us experiencing this issue?
can we not all get together and do something about this through legal means?

please excuss me if this is ignorant, i am not very clued up when it comes to legal. i just know that its likely the sad rule of the bigger guys always wins in court. ie Cell C squashing our legal attempts to get what we pay for?

Read T&C if you didn't do it before. You will see that you have forfeited all your customer rights by signing such conditions. Even government oficials declared cellphone contracts not compliant with CPA, but no further action was taken.

BTW, cancelling Cell C contract is easier than with other networks. There is no extraordinary penalties and device cost is handled separately.

it is easy,
and governed by the CPA which they comply with.
10% of the outstanding contract + the outstanding portion of the handset.

i would cancel my contract, however i signed up to use a network and pay off a phone at the same time. not to purchase a phone outright.

What I would like to know is whether there is any way out of the contract with a lower "buy out" amount because Cell C is not keeping its part of the bargain by rendering a service. I pay for a service -- I expect coverage.

However, I have no coverage in the Cape Town city centre, I have hardly any coverage at home in the Northern Suburbs, I cannot have a conversation with another person on the Cell C (or any) network less than a kilometre up the road, and internet access is virtually non-existent.

I do not expect anything spectacular. I just want to be able to use my airtime and data (that I have already paid for) in the way it was intended to be used. Surely, a contract should work both ways: I hold up my end; Cell C should hold up its end.

I inquired a while back about cancelling and was told i had to pay in the balance of the contract, simple as that. CPA has no teeth so dont even try

What do you mean not compliant with CPA?

Surely one can sue or get out of the contract if their part of the contract is not held up?

How are you going to prove you're having an issue?

The same way people always pip up here saying they don't have any issues Cell C will just say it's your fault that it doesn't work. Cancel, take the cancellation fee as school fees and just never look back.

Keep a record of all the helpdesk reference numbers, PMs, emails. Shouldn't be difficult.

How's that going to help? They can blame the weather for your bad reception. There is just no way to prove with concrete evidence that the issue is on their side, there is a million things that could have caused it.
