i was thinking that should sentech not improve we cancel our debit orders and set up a trust fund and put our subs in there so the money goes somwhere that can be audited and shown to sentech but the clincher is they have to meet our basic requirements as per the advertising/marketing that induced us to sign up before this gets paid over to them the cost of the trust will be carried by sentech [portion of fund will fund the fund] should they foppie badly again the fund could be used to litigate ... so they will pay for us to sue them ...

any takers ??

you can't do that. unfortunately. That's breach of contract, and eventhough it seems like the "right" thing to do, you are putting yourself into a situation where you are "wrong" and Sentech have grounds to sue you for breach of a contract. It says in the contract that even if you don't have ANY service, you still have to pay. Maybe not in so many words, but it boils down to that. Every ISP has that in their contract. So... no go mate. Sorry. It has been suggested and eventhough I would LOVE to not pay them a cent, we don't have a choice. The sad truth is : pay, cancel or wait until it's fixed...

Makes you sick to your stomach, doesn't it? :(

well lets see what the ASA rules if they rule against sentech we could have grounds to cancel/not pay ...

i spoke to someone who's company loaned them xxx 000 000 rand last year for the roll out and he would want his money back with intrest and sentech certainaly cant afford to default on that rental.

basicaly the money for the roll out did not come from goverment but from a private company that specilices in loaning money to goverment they also won the top non listed companies award last year.

sentech has debts to pay and has to keep onto its subscribers for dear life or else they in for it ... this is where we need to be coherent they will not be able to afford litigation and servicing there debt if enough band together .... they will have to do the right thing ...

well they do *seem* to be <i>trying</i> to solve the problem. I have no problem with contended international bandwidth but when my email is coming in at 3KB/sec I get annoyed. But let's see what pans out. They have until the 3rd monday in August before we start reacting to non-delivery on promises.

It is an interesting term of Sentechs' ICASA licence that they may not 'cross subsidise' between their distribution and other business and MyWireless. Presumably that is on an annualised accounting basis, so the clock is ticking.

Considering that many users have, for many months, not recieved service as expected, I was wondering: Do we have such things as class action suits in SA and young hungry law firms wanting to make name and some bucks to boot who take these sort of things up?

Somethings are occuring, yesterday had a call from helldesk o confirm I had received the UUP and today an email asking if my speed have improved, which they have, slightly eg from 3 -4k d/l to 5 -6k d/l speeds. Still not there though.

I had an open speed ticket for the last 1.5 months, (they forgot to call to find out if they could close it 2 days later)
Anyway, I was called about it yesterday, and the techi asked if speeds had improved, I responded that it was only 3 days slump and then it returned back to normal.
he confidently said, I might think its gone up, but thiings are going to get much better in the next few weeks!!

Rather than boycott payment, how about taking them to the small claims court for a refund of the money you have already paid while they try to fix their service?

All you need is one ruling in your favour for one month, and the rest (as they say) is simple. Anyone with enough time to do this?

Where the ASA rules for them or against them, they have admitted in public that their service is not up to scratch and hasn't been for some months. Send them a letter demanding a partial refund for the months they have admitted to (say 50%) and see what happens.

The problem with a Class Action suit is that you get lawyers involved. If you go the small claims route <b>they are not allowed to involve lawyers</b>, and if the person(s) filing the claim are pretty bright, I'm sure it would be easy to run rings around the CEO of Sentech, or whoever defends the suit.

I would do it except (a)I don't pay the bill, my brother does, and (b)both of us are hecticly busy right now. Sorry
