These WhatsApp messages can now land you in jail in South Africa

President Cyril Ramaphosa has proclaimed that most of the Cybercrimes Act will come into force tomorrow, including provisions on “malicious communications”, Ellipsis Regulatory Solutions reported.

These provisions criminalise the sending of certain types of harmful messages on social media in South Africa.
 
I welcome it. It just makes things a lot clearer and bring it in line with modern technology and the speed of communications. This law makes things crystal clear. Very happy with it.

Out of curiosity I wonder if somebody will argue a public interest exception to intimate images or material of celebrities :) We don't yet have a massive paparazzi in South Africa, but it would be nice if their activities are curtailed. And of course "leaked" celebrity video tapes are nou pretty much illegal (hooray! My life will be better if I don't ever have to hear or see anything about Keeping Up With Some Rich Girls That Managed to Get Famous.) And hopefully it means that SA websites can stop with those annoying Taboola ads!

There actually needs to be a clause attached to that consent.

Yes, that is an intimate photo and you don't have a signed contract in triplicate from Lucy and all her related namesakes across the globe.

So this proves that Whatsapp is not encrypted or contains a backdoor. Pretty much what we knew all along.
Simple solution- don't use Whatsapp anymore...
No actually it doesn't, all of the cases locally involving WhatsApp were from people screen grabbing and sharing WhatsApp.

Seriously not an expert, only been to two talks on the subject, but also, the law is bigger than WhatsApp, this forum has been covered under the same law for a few years. So like this guys post as a random example: #42 for instance is a problem for the entire forum, so are many posts that could be perceived as racist, sexist, or insinuate violence. The forum is considered a publisher, so the publisher is responsible for that post, much the same way as a radio station or magazine is responsible for it. The law also states "people partaking in the sharing of malicious content via WhatsApp", which could mean that simply being a member of the forum who simply view the content makes you equally guilty.
 
...can they retrospectively apply them to dodgy messages sent on Twitter in July?

  • Threaten people with damage to property or violence.
