Prime drink company sued in trademark case by US Olympic committee

The US Olympic and Paralympic Committee is suing Logan Paul and KSI's Prime energy drinks brand, accusing it of trademark infringement.

It claims that Prime is using trademarked Olympic phrases and symbols on a special edition of its hydration drink featuring basketball star and three-time Olympic gold medallist Kevin Durant.

The committee said it does not have an agreement with Prime for the use of its terminology and trademarks, and said its actions had been "deliberate" and "in bad faith".

Probably the text that says "3X olympic gold medalist" but that is just plain stupid now if you want to talk about anything related the games, you are infringing on trademarks?
 
The USOPC has trademarks on OLYMPIC and TEAM USA which they in turn have licensed to Coca-Cola that allows it exclusive use of OLYMPIC trademarks, including OLYMPIC and TEAM USA for beverages in the United States.

I very much doubt that Prime will want to take on the USOPC and Coca-Cola that would the most bone headed move ever, so I suspect they are going to fold quickly and change the wording.

Honestly not sure what they where thinking, Paul might have some name recognition in the US but it just seems like another random energy drink, not surprised it tanked.

That's a load of bullschit tbh. But I guess someone made plenty of dollars for their pocket

Surely you can't trademark common words like Olympic and Team USA?
Hermes recently lost a widely publicised court case where some guy wanted to trademark a name(I think it was his birth name) which included the word Hermes. Hermes is a Greek god of some sort.

Actually you can. Do you know that you also cant sell your Academy Awards statues either, you have to return them.

Tesla, you also cant sell it within a certain time, and selling a Ferrari or lending it out can get you banned from buying any others.

We live in a world full of rules. Olympics is trademarked.

Ironic now I feel like watching that movie "The Man who sued God". If you havent, you should. At the end it boils down to the phrase "An Act of God" in the insurance company's papers, saying that they wont pay out if the damage is due to an Act of God.

 
Do I need authorisation to use the Olympic rings, the word “Olympic” or any of the Olympic Properties?

These words and symbols are protected by intellectual property rights owned by the IOC so, in general, you need the IOC's authorisation before using them in the market.
 
They should put a disclaimer on the bottle to tell people to not be misled by the Olympic committee’s claims.
PRIME sales are right down as most of the Hype is gone, so now they try to create new hype to get people to buy it again.

Welcome to the world of trademarks. Jenni Button can tell you all about it. She sold her business Jenni Button then tried to make a new one called Made by Jenni Button. Unfortunately she sold Jenni Button with trademark rights so she was stopped with the new name.

Kylie Kardashian tried to Trademark the name Kylie but it backfired on her because Kylie Minogue and quite a few other celebs objected, so it was chucked out.

Mcdonalds SA could only operate in SA after they acquired the Mcdonalds name Trademark from a clothing store in Wynberg, Cape Town.
