The Financial Sector Conduct Authority (FSCA) added to her woes, which probably prompted her to cite the powers of divine intervention in her speech later that day.

The FSCA, which is a regulator for financial markets and the financial services industry, is the latest to join a growing list of institutions and individuals that are hauling Mkhwebane to court for her adverse reports.

The FSCA filed an application at the Pretoria High Court, asking it to review and set aside Mkhwebane’s report, in which she found that the regulator’s former executive officer, Dube Tshidi, acted improperly in the performance of his duties for more than a decade.

In court papers, Tshidi has hit back saying Mkhwebane’s findings are “procedurally irrational” as the Public Protector didn’t consider detailed submissions he made to her office in response to a letter about her investigation. Tshidi added that Mkhwebane failed to give any “reasoned justifications” for her findings.

“The only other explanation for these failures is gross incompetence and negligence on the part of Advocate Mkhwebane in the performance of her functions as a Public Protector,” he said.

In a final blow, he also wants a personal cost order against Mkhwebane for the FSCA’s application to review her report.

ATM 'disgusted' by efforts to remove Public Protector from office

The African Transformation Movement has leapt to the defence of Public Protector Busisiwe Mkhwebane and rejected calls for her to be removed from office.
“The ATM has been following with shock and disgust media utterances attributed to the DA on the removal of Advocate Mkhwebane,” the party said in a statement over the weekend.
Mkhwebane has come under fire with the courts having set aside some of her reports and is facing a bid by the DA to have parliament review her fitness to hold office. Her investigation into the alleged Estina dairy farm project scam was recently set aside by the North Gauteng High Court as unconstitutional and invalid.
“The call by the DA exposes its wanting understanding of the constitution, and also confirms its long harboured vindictiveness in opposing Mkhwebane's appointment from the very beginning,” said the ATM.

The ‘Sunday Times’ reported that the public protector wrote to the speaker in a strongly-worded letter, accusing her of being in breach of Section 194 of the Constitution and violating parliamentary rules.

Public Protector Busisiwe Mkhwebane has reportedly threatened to take National Assembly Speaker Thandi Modise to court if Parliament goes ahead with an inquiry into her fitness to hold office.

The Sunday Timesreported that Mkhwebane wrote to Modise in a strongly-worded 12-page letter, accusing her of being in breach of Section 194 of the Constitution and violating rules of Parliament.

This after the speaker referred to the justice committee a motion by Democratic Alliance chief whip John Steenhuisen that removal proceedings be instituted against the public protector following several court rulings into her reports that were adverse.

According to the publication, Mkhwebane argued that Parliament doesn’t currently have specific rules that dealt with the procedure to be followed on the public protector's removal, despite Section 194 stating that the public protector could be removed from office based on “misconduct, incapacity, or incompetence".

“Instead the [justice] committee is given a free hand to adopt a clearly unlawful and unconstitutional process where the public protector is simply called to a meeting and berated about cases that are pending before the Constitutional Court and the Supreme Court of Appeal,” Mkhwebane’s letter reportedly reads.

Parliamentary spokesperson Moloto Mothapo told the paper Modise had responded to the public protector, saying the proceedings to test Mkhwebane’s fitness to hold office would continue. While, Mkhwebane’s spokesperson Oupa Segwale, on Saturday, said they had not received Modise’s response and would not comment further on the matter.

How can a Public Protector be a Public Protector is nobody trust this office, not even the public and is seen to be captured by the EFF and radicals? :unsure:

Not sure why the butthurt. Who appointed her? Her in office will show those that appointed her why its important to appoint properly. I personally hope she serves her full term.

MPs set September date to discuss Public Protector's future

Parliament will officially discuss and "map out a way forward" regarding Public Protector Busisiwe Mkhwebane's tenure after a formal request to review her fitness to hold office.

The DA asked National Assembly Speaker Thandi Modise to urgently consider an inquiry into Mkwhebane's tenure, which was referred to the portfolio committee on justice in June.

I hear you but can you imagine how much she will have to pay in personal costs if she lasts a full term? Her mother is already worried as per this article.

Mkhwebane's mother, Martha Mkhwebane, told News24 that she could not stop wondering about where her daughter would get the money from.

"The money she must pay is close to R1 million… what did she do to deserve this?" asked the 87-year-old pensioner during an interview at her home in Kwaggafontein in Mpumalanga.
