R1700 bill - ''broke contract terms''

hi :mad:

got the bill yesterday, R1700! i thought Telkom must have mucked up some where with my 1mbit upgrade as i have seen them mucking up with accounts a few times.

so i phone the account enquiries today and i was told that i have broken the 24 month router contract by upgrading to 1mbit from 384k!

WTF is that true? that is really sick. someone higher up is calling me tomorrow.

Well surely that would mean that they too broke the contract terms of 192 users when they upgraded them to 384? Doesn't really make sense because you're not paying them any less than you initially were.

DSL Migrations

A migration fee will be charged should a customer choose to downgrade from any DSL service to a lower speed service i.e. DSL 512 to DSL 384.

Customers downgrading from an existing Home or Business DSL service not on a 24-month contract can downgrade to a Home or BusinessDSL Bundle, and receive a free modem of choice, subject to the signing of a 24 months DSL Bundle Contractual Agreement and paying the migration fee.

Customers on the 24-month Bundle can downgrade to any DSL offering, but will be liable for the penalty on the existing contract as well as the migration fee.

An existing Bundle customer can downgrade to a lower speed Bundle and receive a free modem of choice, subject to the signing of a new 24 months DSL Bundle Contractual Agreement. In addition, the customer will be liable for the penalty on the existing contact as well as pay a migration fee.

An existing Home DSL 384 Bundle customer can upgrade to HomeDSL 512. The customer remains liable for the penalty on the existing contract, but no migration fee is payable.

An existing HomeDSL 384 Bundle customer can upgrade to HomeDSL 512 Bundle and receive a free modem of choice, subject to the signing of a new 24 months DSL Bundle Contractual. The customer remains liable for the penalty on the existing contract, no migration fee is payable.

Strange how they fail to mention things like this when you order the upgrade. You would think that they'd at least have the decency to mention it. But as we all know this is still Telkom and failing to mention things (lying) is their speciality, especially if it's in their favour. Sad but true :(

When I applied for ADSL, I got a SMS from Telscum saying that I must first pay a deposit of R700 before they can upgrade the line to ADSL. The said it's something to do with their points system. I went to the local office and they told me that I don't have to pay it after all. At first i was told that I should pay it and I would get the money back when I cancel the ADSL. But the hell would I apply for ADSL with the intension of cancelling if I don't have any other options.

Telkom will try to nail you for everything, further more, make sure they have released you from your contract. I would also contact there Managment Department or email Icassa, and inform. you will probally get your money back

Yes you would no longer be subject to the contract.

However as I understand the penalty should not be payable if you continue with the dsl service and do not require a new "free" modem.

Was the R1700 the total bill? AFAIK the penalty for early cancellation of the 384 supreme contract is supposed to be R65(ex vat) for each month prior to the end of the 24 month period. Allthough I agree it should not be payable at all.

R1700 - about R200 for calls.

we are in the 13th month of the contract.

If the customer cancels the service before the 24-month contractual agreement period has lapsed, the customer will be penalized according to a sliding scale for early cancellation penalties, which is equal to R62.19 VAT excl.multiplied by the outstanding months of the contract which will be levied on the customers final account.

The migration fee is only payable when you downgrade your speed.

Can I be the one to point out that you were the advocate for telkom contracts and now it's bit you in the arse! :pYou should have known it breaks the contract though - http://mybroadband.co.za/vb/showthread.php?t=42322

I disagree - no evidence of the fact that upgrading breaks contract was provided in the thread - telkom has also informed me that upgrading of linespeed can be done at no charge - I believe this is just another example of telkom not knowing their own rules.
