It's astonishing what Zuma' presidency did for inclusiveness. Before Zuma, there was only a few select people that even considered going for the role. Zuma has dragged the bar down so low, that he has opened up the possibilities to some of the worst candidates, and South Africans really have to fear each possibility.

Inclusive presidency for all.

I think he must, but the trick could probably be that he will be allowed to test the waters first and see how it goes.
He's not allowed to participate in politics so he will be impeached as soon as he officially kind a political party.

I really don't see him getting into political arena tbh. Total suicide in my opinion - to tarnish whatever goodwill he earned for his stance against zuma after "mybb" thought he was his lap dog.

From what I read so far, it looks like he can be in politics but if he gets into parliament, he needs to let go of his retirement benefits.

No, can't be in politics,
Note 17(vi) further states that a “retired judge must not enter party politics”. (This means that Mogoeng will be in breach of the Code if he decides to enter party politics, as some have suggested he would.)

Sure, but this is what I read. This made me think that there is a way for him to enter party politics.


However, if it is indeed so that the former Chief Justice is running for presidency, the Code of Judicial Conduct may stop him in his tracks. Under Article 17, applicable only to retired judges, Note 17(iv) states in no uncertain terms that “retired judges must not enter party politics”. Although there is no definition of‘ party politics’, it would be extremely hard for anyone to argue that running for president, representing an organisation, is not party politics.

Mogoeng would therefore need to resign as Chief Justice, giving up the title, status, privileges, and benefits of judicial office. Failing which, he would be in wilful breach of a Code he brought into being and was the chief enforcer for many years. If found guilty, it would constitute gross misconduct of the type that would lead to his impeachment, and a disgraceful loss of judicial office and the benefits that come with it.

Similar to how Trump reduced the standard for US presidency.
