SARS accessing my bank account

Hi all,

So I have an on going dispute with SARS where they decided to make me a provisional tax payer and then guesstimated that I earned an extra 50K last year (2016/2017) which they subsequently said I owe them money for.

My tax folks have lodged an official dispute etc with them (and they've acknowledged receipt of this) but I'm concerned that they may attach my bank account.

If I move any surplus funds in my current account (account on record with SARS) to say a savings account within my banking profile, will they be able to attach this?

Not sure if they can "attach" it as you mentioned, but they can certainly look at your statements for further investigation.

Also, R50k in earnings more and the tax payable on that isnt exactly a considered a "whale" for SARS, I doubt they will spend too much resources trying to recover the tax (if it is in fact payable). Just make sure you follow procedure as you have been, and that you keep all records.

Thanks for the feedback guys...

This whole process has been on going since August last year - I can certainly say that SARS has gone to the dogs!

Move the money.

happened to someone last week.
They took money owing even though the dispute was not closed. It was an "error" on their side however they can't just transfer the money back. It has to follow a "process". they getting the money back but not confirmed when.

SARS can approach your bank (and any person who owes you money) to pay monies towards your tax debt.

SARS is supposed to give you 10 days notice before they remove any funds (so you can make representations).

SARS does not need an account number. The banks must provide SARS with all your banking information. A failure to do so will result in the banks being held liable for your debt.

If by "official dispute" you mean an objection or appeal; this will not cease SARS' collections. You will need to make a separate application for suspension of payment.

Yes SARS can attach anything including any incomes from elsewhere or they can ask your employer to pay them first before pay your salary. Sadly they do have that much power. What you can do is transfer it into a safe haven but no local bank is safe.

How is it their fault if you have questionable transactions in your account?

If anything it's proof that they are actually doing their bloody jobs.

Where is questionable transactions mentioned?

Explain why they didn't carry forward historic RA contributions correctly as they should have when filing season started last year? Cause they have gone to the dogs.

No questionable transactions - they made me a provisional tax payer and then guesstimated that I eared extra, taxable funds (which I honestly didn't).

This all happened whilst still being registered for PAYE and my employer pays the PAYE portion on my behalf.

Okay I re-read your post now.

I initially read it as them linking it to a 50K transaction but now I see that you say they just guessed at it.

Do you do some freelancing on the side or something? if you are a salary earner it makes no sense to just switch you to provisional.

Nope..

I honestly think the accountant at the office who originally registered me for PAYE when I joined my current co stuffed something up...
but I'd like to think that competent tax folk have been paid by the co to sort it out.

Yup - they can pull money straight from the bank a/c without any input from you.

Not much you can do about it tbh

Incorrect carry forward of retirement fund contributions is due to many years of neglect. In some instances the errors goes back to 2000. Due to the amendments to section 11(k) of the Act these things came to a head last year.

Thanks for all the feedback folks.

Decided to be cautious and moved everything barring 100 Ront to my wife's account.
