So, I didn't file last 3 year's returns and SARS imposed admin penalty and I paid just now. How do I file old tax returns online? Any idea? I tried "Request Historic Issued Assessment" but site says "There are no available assessment notices which have been issued for the period which you have selected"

Why did you pay? I've managed to get penalties of more than R40k waived for clients.

To submit old tax returns, click on the year you want to file and then click on the request button.

@signates - I too had to pay penalties similar to the above. Please could you kindly elaborate as to how i could have waived the penalties or what could i have done to avoid the penalty so i may be aware for future recourse?

Well, I didn't know there was an option. Next time, I shall think a bit. :) Thanks.

Best would be to get a Tax Practitioner to get the penalties waived.

SARS is more concerned about having everyone compliant than charging and collecting administrative penalties. If a taxpayer is open with SARS and submits outstanding tax returns, I have found that SARS is very lenient and have always had penalties waived.

They will however never waive taxes due and interest charged on late payments.

@signates - one more question. For rental property, I got sundry expenses like gardening, faulty remote replacement, electrician - most for which I don't have bills. I don't suppose I can put it under expenses, can I?

You can write the miscellaneous amounts on a sheet of paper - I usually do it on a spreadsheet. They never query it

SARS told me I had not submitted a return for 2010, yet I received an assessment from them. Upon asking how they assessed me if they say they had no return, the person said the computer does it. What nonsense?

They are using this as an excuse not to refund me R17500 from a 2009 return. Each year I query it I get a different excuse

Here is my question, i submitted my return for this year and they said they would refund me R16K , then asked to audit me and submit documents which i did, then they came back and said that i also owe a fine of R500.00 for not submitting in 2008 and 2009. I paid the fine yesterday just so thats sorted out. What happens now to my refund they owe me for this year?

Thanks, I already got spreadsheet listing expenses I incurred, however, didn't get sign of gardener many times. Let us hope that is ok.
