Schit. The news24 article I posted earlier seems to have jumped the gun.

The school's urgent application for an interdict against the EFF was denied :eek:

The school's argument is likely inadequate. I read the article, and I see the application is still under review. I don't know which argument was pushed in urgency.

But a judge says the school has no right to dictate where protests can take place.

This judge should know the schools act, which was also most likely not argued by the school which I would have argued. If any disturbances takes place during this week, they will have their interdict granted.

For now, the court has accepted an undertaking from the EFF that it won't disrupt exams at the school.

the EFF didn't undertake their promise with Clicks.

I am curious, who is the judge?

so EFF says they won't disrupt exams at school this week? Does that mean they will petrol bomb the place this weekend when the scholars aren't there? :unsure:

Absolutely nothing. It was a private event organized by private individuals for some other private individuals.
And because there weren't any black people, it was racist of them to have that event. Regardless that it was private, etc.

But OFC the EFF showed up without any context and now that it is made clear that it was a private event, etc. they are moving onto reacting to how they were treated for showing up. They have made themselves the reason for protesting.

they don't even mention Siya Ntuntwana in the article. They write about Ofentse Maybe, post a video about Ntuntwana, and both are reported as former students. If I were Ntuntwana, a former pupil, I would not have been wearing my school clothes, unless of course he was interviewed on the final day of his examinations, and have passed his grade.

I don't understand though. Wasn't yesterday's behaviour of the EFF enough motivation? The law is pedantic sometimes

Just remember that a court must look at the circumstances, and in that circumstances balance everyone’s right. Yes, it can be biased at times, but here it is simply the urgency which was dismissed and not the interdict application per se. It is under review, eNCA sensationalised it, that is all.

When you argue in urgency, your arguments are limited as it is essentially time constraint hence urgency. The court will review the argument once the arguments are submitted in detail, derive merits and apply to the circumstances and make their ruling. This all being said in layman.

I am sure it will be granted on Monday. Say the EFF disrupt, again, in this week, then a request in urgency can be made again and it will be granted.

A good lawyer drives the right argument, a bulldog lawyer pushes the argument. I am in the opinion that the wrong argument was made in urgency, but legal eagles know best.

The only time I was being acquainted with law was when I divorced, and I have given witness testimony. My experience.

The matter was heard before Judge Siraj Desai, who said: “The right to free assembly is fundamental. The issue is contentious as is. If the school was segregated, it is so repugnant that the protest is legitimate.

The bolded part I find very alarming, he's already made his mind up...

So, looking at the case without seeing the court papers it does seem to be more than an interdict. I am going to wait on the papers.

EDIT: Just to add, the EFF is again 'under'-represented in court by a white lawyer :sneaky:
