screamer CPE equiptment question

Is howzit still around? Or any other screamer rep? Or maybe anyone else that might know.

I have screamer wifi, and we had a bit of a lightning storm, and now my CPE is buggered, my switch is @#*!? And my LAn port on my PC is dead too, so I phoned screamer, and they said I will be invoiced for repairing the CPE, but I feel this is wrong, as they clearly said, when I first got it, that the CPE is not mine, in fact they stated "all equiptment and cables stay the property of Screamer, its not bought, its rented", so if it it is there equiptment, should they not be held liable for all damages on their equiptment? I understand that the switch and the PC lan will be my problem to fix.

Any help / advice will be appreciated.

I used them a while back, and was told the same thing. But I had so many terrible experiences with them, and the head office, as well as the local "technicians" if you can call them that.. that I eventually gave up and moved to adsl.. been in internet heaven since.

Point is, they are exactly the kind of company that would try to screw you on this.

I must confess, touch wood, up to this stage, I have never really had huge problems with them, I don't really mind paying the fee to fix the CPE, but would just like to know if I am suppose to.

Hmm, my CPE never got damaged, but I do clearly remember them telling me when I signed up, that I'm renting it from them, and if there are damages to it, they will replace it at no cost to me. When they came over to survey my place for line-of-sight, they told me I needed to buy a 3m pole and bracket so the CPE can by mounted higher. The thought of the 3m high pole above my roof prompted me to ask them about lightening damage.. and they confirmed they'd replace it at no cost to me.

After I cancelled with them, they took months to come and collect the CPE.. it was just sitting on my roof for ages.. One day they came and took it when I was not home, they took the pole and bracket too.. which I bought, so was in fact still mine. I didn't bother chasing after it, I was sick of them at that point.

Exactly, I can also remember them answering about lightning damage, that they replace it, coz it is their's, now they are telling me, its not part of the "warranty".

From what I know about rental equipment, acts of God and negligence aren't covered in 99% of rental agreements. You spill coke on it, your house burns down, etc it is your responsibility to replace.
