Security companies and PSIRA

Upon raising a query with the local resident's association regarding the fact that our security company has been suspended from PSIRA there response was a curt "Ja, but there are a lot of companies suspended for non-payment that operate."

Now this isn't a fly-by-night company, at least, but they do take liberties with their guards, pay them late, violate their labour rights, etc.

What is the legal ramifications of being involved with a company that isn't registered with PSIRA, a company that makes use of deadly force?

Looks like it may be illegal for them to operate without PSIRA registration :

Section 26(3) of PSIRA Act :

The effect of a suspension of registration is that the security service provider whose registration is suspended may not render any security service, unless the prior written permission of the Authority has been obtained, but during the period of such suspension the security service provider is still bound by all the obligations of a registered security service provider provided for in this Act and in the Levies Act.


Suggest you contact PSIRA and ask them.

Its illegal and if something happens you are not insured.
Trust me on this ;)
All there firearms can now be taken back by the SAPS so if they shoot someone, good ****ing luck to them
You are NOT allowed to operate if you are not a paid up PSIRA company / person

This is my fear, both with regard to legal liability and insurance.

PSIRA has been rather vague and the resident's association doesn't seem concerned. I could do with some hard facts as the legislation doesn't provide enough information, or perhaps requires a legal opinion.
