Hi,

We have a service that adds a bussiness card/diclaimer etc to every of our clients outgoing email. Unfortunatly some clients do not have the infrastructure for this on their own site.

I was thinking of setting up 2 ADSL lines and using FreeBSD and Exim, set up a system where the client point their server to my SMTP servers. Unfortunatly, because the 165 address range is blacklisted, my SMTP server cant send direct. Am I allowed to setup my Exim to Smarthost to smtp.saix.net or will I be seen as a VISP. The problem is that the mail transfer through my systems can reach almost 2 gigs per day.

As far as i know if you are a telkom ADSL user you will have access to the smtp to send mail...

I've had 30 odd users sending mail through a local smtp server which routed it to the smtp.saix.net server...

You should not have a problem...

It does work, my main question is if it is legal.

On the Saix Usage Policy it says the following on EMail

Sending unsolicited mail messages, including, without limitation,
Make-Money-Fast (MMF) schemes, chain letters, commercial advertising and informational announcements, is explicitly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site. As it is against our policy to allow Mail Relaying via SAIX we implemented a process to prevent this. This means that our VISP (Virtual ISP) end-users connecting to a SAIX PoP may make use of smtp.saix.net as their SMTP host. What will not be allowed is for the VISP to point their mail server to smtp.saix.net as a mail relay</font id="blue">

SO, in summary, 40 odd clients (each with about 40 odd mailboxes) send their mail to my mail servers, my mail servers then relays it through the SMTP.SAIX.NET mail server. According to the above, VISP are not allowed to do it. The question is, will I be seen as a VISP?

Yes. You are in fact relaying to SAIX's smtp server on behalf of clients who are not SAIX end-users. This probably constitutes a breach of policy. If those clients were part of your own network it would be different, I think.
