How this goes:

1. Student screams racism
2. EFF jumps up and screams racism.
3. News24, IOL etc go DEFCON 1.
4. Twitter goes DEFCON 1
5. Social and msm media tears, anger, mass victim circle jerk.
6. EFF engages nuclear vote grifting mode: riots, tear gas and bricks.
7. Judge or SAP rules non-racist incident
8. Twitter grows dead quiet. Mass deletions and backtracking of social media posts.
9. News24, IOL quickly post covid-19 warnings or Zuma update. That should smooth over our shenanigans.
10. EFF dismisses court/SAP investigation, obviously racist whites have captured the judiciary and says will launch own investigation.
11. All is forgotten and EFF quietly slip it into the bin hehehehehehe.

6 months later. Repeat all of the above.
This is most probably the best way a person could sum all of it up. This deserves to be stickied in every thread.

See his disciplinary hearing will start today, not sure of the charges but sure a good lawyer will get him loose on any race charges (no evidence) and the pee'ing thing will likely not warrant expulsion but a fine or some community service.

Does the university allow for professional legal representation? Some employers don't, unless it case is handled externally.

South Africa is majority black. If they don't mention race/ethnicity, it's safe to assume the person is black/coloured.

But why is it like that?

I'm not a media person so I have no idea.

For someone very willing to speculate, make assumptions and deductions (as we all do here on the forums), you certainly do seem to lose this ability at the strangest of moments, fairly regularly too ;)

Not sure where you suddenly bring other countries into the argument. Strawman? Confused threads? As all the above quotes were in response to the previous, you should be able to follow the arguments without much effort now.

Stellenbosch University will keep to their current protocols and procedures which are in place which is good, but as I said, the mob won't be all too happy. I see there is a another protest later today at the Rooiplein.

The process will have to run its course, I believe, however, the decision can be legally appealed. Although the student is suspended, he is still enrolled at the institution and hence have that permission to be educated and examined though with reduced access to the university’s resources. I would guess that they do have procedures in place to accommodate suspended students whilst the matter is still under investigation and undecided.

22 Discriminatory Misconduct and Sexual Misconduct: dealt with by the Equality
Unit
22.1 Any suspected Sexual Misconduct and Discriminatory Misconduct shall
ordinarily be dealt with in the first instance by the Equality Unit in terms of the
policies governing that Unit.
22.2 The Head of the Equality Unit may decide to refer the matter to the CDC for an
enquiry, in which case it becomes a Disciplinary Matter and is dealt with by the

in the ordinary course as if it had been referred for an enquiry by the

discriminatory or Sexual Misconduct, the matter may be dealt with as a

31 Representation and Legal Representation:
31.1 A Student may choose to be represented in Disciplinary Proceedings by
another Student or staff member of the University. This is referred to as
Representation in this code. A Student appearing before a HDC, RDC, CDC
and DAC will have a right to Representation.
31.2 Legal Representation is not ordinarily allowed, though it may be applied for in
hearings before the RDC, CDC and DAC.

31.3 A Student appearing before the RDC, CDC, or DAC on suspected misconduct
may apply to the chairperson of the RDC, CDC or DAC, as the case may be,
to be allowed Representation by a Legal Practitioner.
31.4 The application must be submitted within five Days of notification to appear
before the applicable disciplinary committee.

31.5 If the Student is unable to apply within that time, the application must set out
the circumstances that led to the late filing of the application and ask for
condonation which shall be granted if the chairperson is satisfied that the
Student took all reasonable steps to submit the application in time and did not
unreasonably delay the submission.
31.6 The convenience or availability of any particular Legal Practitioner will not be
regarded as good reason for a delay of Disciplinary Proceedings, save in
exceptional circumstances.
31.7 The relevant chairperson has a discretion to grant an application for Legal
Representation, after taking into account at least the following:
31.7.1 The need for the expeditious determination of the matter in view of its
impact on the wider University Community or any particular members of
the University Community.

You have to apply but how do you apply within 5 days if the period of notice is shorter. At Pretoria it's a right and you don't have to apply.

It would be highly unfair to not allow a 19yr old out of school legal representation when those on the other side are senior attorneys, advocates, professors you need to answer to. You don't stand a chance.

I think the university is going to be challenged by their preconceived racism accusation. The public decided that it is racism, and this university ‘intellectuals’ obliged as did its umbrella body. In the case the racial charge is dismissed by the system then the university leadership isn’t in charge.

Personally, I am not too happy with how the university is dealing with this matter, but it as per the usual under Wim de Villiers. They aren't even giving the rape incident any public time, likewise with the media, they have a small segment on the rape allegation, but then move on to their perceived bigger issue. I can't stand by this, and are ashamed by Chancellor Cameron not calling this out to promote equality. Priorities.

Wim is the type that would feed his own children to the lions to appease the people. Wrt to the rape incident they said it's now a criminal matter and must run it's course...

So is the urination incident, a criminal case has been opened by the victim and hence it must run its course, but no, it needs to have social dialogue?

Rape is a ongoing issue on these campuses, not enough is being done to address this, where is the dialogue?

That's my point... the rape case it looks like they will only handle once the criminal case is concluded but the pee story they can't get to fast enough and screw the associated criminal case.

Pee guy needs to insist on legal counsel else they gonna burn him at the stake.

Interesting to note the university already missed their deadline of Thursday and it doesn't look like anything regarding the case will be announced today - Thursday always looked too short to me as the university needs to ensure there is procedural fairness...

Yeah it is worth noting that amongst the most brutal people to the prisoners in the Nazi concentration camps were the kapos; other Jewish etc inmates who were given privileges to "guard" (brutalise, beat whatever) their fellow prisoners. Wim fits the stereotype to a T I reckon. Feed others to the race crocodile in the hope that it east him last (sorry Winston).

As regards legal representation I think US could come unstuck if they don't allow it, assuming du Toit wants it. I think the fees must fall criminal who was excluded by Rhodes won her case (in the courts) on these grounds, sort of ("The decision to ban her for life from the institution was taken in her absence and that of her legal representative").

I think the case for "procedural fairness" may have been lost already, US having spouted enough (Cameron etc) to indicate that they have racist prejudices against white students. IMHO of course.

Inaction by US on the rape case is just racist hypocrisy. All quite worrying really.
