Suspended nuclear regulator member takes Mantashe to court

South African Energy Minister Gwede Mantashe is being sued following the suspension of a National Nuclear Regulator board member who also works with a civil society group fighting against the lifetime extension of the continent’s only power reactors.

The suit filed by Peter Becker, who in addition to serving on the nuclear regulator’s board is a spokesman for the Koeberg Alert Alliance, will be heard by the High Court of Cape Town on Feb. 8, according to public documents seen by Bloomberg.

South Africa is legally obliged to appoint a nuclear regulatory board member who represents communities potentially affected by industry decisions.

To be honest, it doesn't look good at first impressions.

Becker, who was suspended on Jan. 18, argues in the documents that Mantashe didn’t have the legal authority to suspend him from performing his duties on the regulatory board.

If the Minister does not have the legal authority to suspend him, who does?
It's also interesting that he does not seem to be arguing the merits of his suspension but rather the technicalities, that is usually a sign.
 
This is going to be very interesting... hot on the heels of the latest State Capture Enquiry Report which alleges that Ministers had been suspending Board members of SOEs without due cause, to replace them with 'yes' people. Glad its going to court, so we can hear the ins and outs of this. Pity those suspended Denel and PRASA board members never went to court back in the day.

That's why the Zondo's suggestion of having a board to appoint the boards is so appealing to me, sure the technicalities are complicated but it is a very sound idea in principle.
 
I would have preferred it if he was being sued in his personal capacity. There is nothing that grates me more than a numbskull using taxpayers' money to defend dodgy decisions.
Yep. Us taxpayers are being sued, because the fat cnt represents us.
