All credit to tommygun- he has led the charge and it is because of him that these hearings will come about. It's been no small task for him... as anyone who's ever tried to get icasa to do their job will confirm. tommygun's persistence should be praised- he is the one who has been organising this and harassing icasa because of telkom's non-compliance.

I know a lot of people are doubtful that anything will come of the CCC hearing. Given icasa's record I don't blame you. But we have two choices here-
*moan and bitch and be negative
*be positive

Attitude number one will guarentee failure.... if we are going to adopt that kind of attitude then there's no point to even attending or presenting or trying.

Anyone who wishes to be a part of this you are invited to attend the hearings- they are public, and the support would be greatly appreciated.

Debbie2, correct me if I'm wrong, !CASA's CCC does have the ability to impose fines on Telkodemonopolies for non-compliance even though !CASA's ADSL Regulations do not specify any fines for non-compliance, is this correct?

If it is correct, then my point is that !CASA's CCC should not waste time trying to extract some vague & empty promise from Telkodemonopolies as to when Telkodemonopolies thinks it might possibly consider complying, instead !CASA's CCC simply needs to impose daily fines until Telkodemonopolies does comply - it is time for !CASA to show some teeth and do its job of biting Telkodemonopolies' gonads...

I think one of the main reasons this is only happening now is that most people here prefer to moan rather than take action as my post here and the lack or responses might suggest

The Gazette relating to the local bandwidth issue came out in August last year and from the documentation I have been sent by the CCC believe it or not it seems I am about the only person in the country who has actualy complained using the correct channels.
Telkom are being defended by David Unterhalter SC who looks like quite a hot Law Professor but despite that I feel its time the consumer have their day. I actualy do have some hope.

There is mountains of stuff I am going through - dating as far back as the first set of hearings (looking to **** telkom over with their own words, hehe) - offtop of head i'm not sure what CCC powers are... will let you know when I get to it.

There is only one thing that !CASA's CCC can do to make me smile about !CASA's useless ADSL Regulations, and for me that does not even involve a pop quiz from !CASA with tea & cookies, to find out when Telkodemonopolies might bother to comply with the unambiguous clauses in !CASA's ADSL Regulations.

What will make me smile, is if !CASA's CCC imposes a reasonable fine per unambiguous clause, say R1000000 per clause per day, on Telkodemonopolies for non-compliance. If !CASA's CCC is not prepared to impose a fine, then !CASA is again a big part of the problem and not a possible solution or part thereof.

Having said all that, I admire Debbie2's resolve.
What about getting a revised unambigious set of ADSL regulations? Or am I opening a can of worms here... Easier said than done, I know!

The issue at stake is Telkom's non-compliance with providing free local bandwidth. That is the scope of the hearings- and I think that it is the correct approach to take- ie better to focus on a single small issue of non-compliance than to take on and challange the whole set of regulations.

IIRC the ever incompetent narcoleptic Paris Mashile promised that !CASA's ADSL Regulations would be sorted out - this was on national TV and rpm was there asking Paris Mashile the question, this was a long time ago.

It is reasonable to conclude that Poison Ivy over at the Dementia of Communistications, has instructed her favourite plant, Paris Mashile, not to fix !CASA's ADSL Regulations - the more ambiguous they are, the more money is received by Telkodemonopolies & guavamental back pockets.

I just had a thought - perhaps it has been discussed before and it might be completey rubbish. But could we not use the ASA to basically shut down any telskum ADSL ads because the product offering contravenes the ICASA rulings? They make claims in their ads all of the time that are rubbish, untrue or that make use of telskums own little version of maths. eg the do movies on a 1gig line??? And what about the Telkom music ad that claims you buy tracks for R8 but the top tracks on the site are R10.

just a thought
