Fscking slimy bastards. They hardly even have to put in an effort. All the loopholes have been conveniently put in place for them to exploit. I bet Telkom wrote those fscking adsl regulations themselves and handed them to Icasa. Time to get the torches and pitchforks out!!

I'm sorry but how is "Local bandwidth usage shall not be subject to a cap” not clear!!!

It sounds like it might be time to put a cap in their ar@#

More than a mouthful.
This legal mumbo jumbo is really quite a stroke of genius. I guess these lawyers are actually smarter than they look, but in reality that wouldn’t take much, would it? Anyway, if the lawyers can manage to draft a document or contract loaded with melee-mouthed words such as heretofore, hereinafter, hereunder and the like, they can ostensibly make the document unreadable. Don’t kid yourself. These lawyers know exactly what they’re doing. By concocting their own legal terms and definitions, they have developed a language that insures future business for themselves.

More legal mumbo jumbo if you ask. Jurisdiction, legality, vague, definition of cap etc, ad infinitum.

What did we expect from these ADSL "Regulations" as they were full of holes from the start.
ICASA in my opinion either deliberately or ignorantly made these Regulations Ambiguous and Telkom leaped at the opportunity to tell them so.
More delays .. same old.

Like I said when the ADSL regulations were published: They're not worth the paper they're written on, and now, many months later, it shows.

Blame ICASA, they have Telkom the opportunity for not complying by being ambiguous in the regulations, and just "getting them out of the door" due to public pressure.

Post this guy's picture - he sounds like an arrogant knob worthy of being a Telkom senior employee, and should therefore endure the wrath of angry consumers.

It's ICASA's fault for releasing something with so many loopholes. The draft regulations were even much clearer on the matter. Post Paris's address too, he should also be subjected to burning pickets outside his house!

“Regulation 3.4 is clearly ambiguous,” Telkom said.

How the hell can it be ambiguous! Which words are Telkom confused about!! A 2 year old would be able to tell you what it means!

Keep it up boys, the change is imminent, and doing what you do will only reaffirm resolve of consumer to drop you the second alternative is on the table.

And for Telcums legal department well done, remember how much shareholders money burned in your resolve to avoid responsibilities last time!!!!!

Must agree with TheRodent...

The ADSL regulations took more than two years to draft - then when it finally came out the two-odd pages of regulations were pathetic.

The "no local cap" directive should have consisted of at least a page or two, not a simple sentence.

Blame ICASA for dragging their feet and letting the Friday-tea-lady draft the ADSL regulations.

I think Maritz was spelling out to ICASA that no definition for the word "Cap" is prevalent in the ADSL Regulations?

Although I agree here I think one has to acknowledge the fact that any Advocate or Mediocre Lawyer could have pulled The ADSL Regulations to pieces.

I stand by my statement that The ADSL Regulations were either deliberately or ignorantly put together for the reason of ambiguity and I am biased to think the former.
